전문증거의 의의에 따른 전문법칙의 적용범위

초록
전문증거란 그 요증사실의 진실성을 입증하기 위하여 제출된 진술로서, 그의 가치가 법정 외 진술자의 신빙성에 의존하는 법정 외에서의 증언 또는 서증을 말한다. 이는 Wigmore가 말한 바와 같이 배심재판 다음으로 “영미증거법상의 가장 중요한 법칙”로 일컬어지고 있다. 우리나라의 형사소송법도 영미에서 생성, 발전되어 온 영미증거법 중 가장 중요한 법칙의 하나인 전문법칙을 채택하고 있다. 즉 현행 형사소송법은 제310조의2에서 전문법칙을 명문으로 규정하고 있으며, 이러한 전문법칙의 예외로서 동법 제311조 내지 제315조에서 서증(書證)의 경우를 규정하고 있고, 제316조에서 인증(人證)의 경우를 규정하고 있다. 나아가 제318조에서 당사자의 동의에 의한 전문법칙의 적용배제를 규정하고, 제318조의3에서 간이공판절차에서의 특례를 인정하고 있다. 그런데 현행 형사소송법은 제310조의2는 [공판준비 또는 공판기일에서의 진술에 대신하여 진술을 기재한 서류나 공판준비 또는 공판기일 외에서의 타인의 진술을 내용으로 하는 진술은 이를 증거로 할 수 없다]고 규정되어 있을 뿐, 전문증거의 범위에 대해서는 침묵하고 있다. 미국 연방증거법 제801조(a)에도 ‘statement’란 주장으로서 의도된 (1) 어떤 사람의 구두 또는 문서상의 주장(a person’s oral assertion, written assertion) 혹은 (2) 비언어적 행동(nonverbal conduct,)으로 규정되어 있을 뿐이다. 그런데 근자에 전문증거의 정의에 대한 새로운 해석을 통하여 허용성을 확장하려는 시도가 미국에서도 나타나고 있으며, 주로 마음의 상태의 정황증거로서 제공된 진술과 요증사실의 진실 이외의 어떤 것을 추론하기 위하여 제공된 진술이 전문증거인지 여부에 초점이 맞추어져 있다. 다만 본 논문에서는 우선 미국의 연방증거법에 한정하여 그 해석상 문제되는 점을 살펴보고자 하며, 묵시적 주장, 특히 주장으로서 의도되지 않은 비언어적 행동을 여기에 포함시킬 수 있는가를 분석하고자 한다.
Abstract
The hearsay rule is testimony in court, or written evidence, of a statement made out of court, the statement being offered as an assertion to show the truth of matters asserted therein, and thus resting for its value upon the credibility of the out-of-court asserter. Wigmore calls the rule against hearsay “the most characteristic rule of the Anglo-American Law of Evidence- a rule which may be esteemed, next to jury trial, the greatest contribution of that eminently practical legal system to the worlds methods of procedure”. Anyway, it surveys the general principle and rationale of the rule against hearsay, scope of the hearsay evidence, Especially nonverbal conduct not intended as an assertion and circumstantial evidence. Determining whether a statement is hearsay when offered to prove a fact of consequence in the context of a given litigation generally poses little problem, provided th basic definition of hearsay has been mastered. Occasionally, however, a statement objected to as hearsay presents an extremely difficult determination for the court. Many of the statements presenting difficult questions concerning the proper interpretation of the hearsay definition may be viewed together as statements being offered “not for the truth of the matter asserted but rather as the basis for drawing a nonasserted inference” and statements being offered “not for the truth of the matter asserted but rather as circumstantial evidence of a fact of consequence”. Also, Clarity would be fostered, and confusion eliminate, if the definition of hearsay was revised in form but not content to declare that hearsay includes (1) a statement which is relevant only if the declarant believes the matter asserted to be true or false, and (2) a statement whose relevance depends upon the matter asserted being true, without reference to whether a further inference is then going to be drawn. Moreover, statements offered as circumstantial evidence of a state of mind, and statements offered for a further inference, are properly classified as hearsay.
