지식재산권의 분쟁에 관한 최종판결은 발명의 독점적 권리에 대한 불확실성을 해소한다는점에서 금융시장에 새로운 정보를 제공하며, 시장은 이러한 정보에 반응하여 기업의 가치를재평가하게 된다. 본 연구는 지식재산권 분쟁의 최종 판결이 주식시장에 미치는 반응에 대한실증연구를 수행한다. 특히 소송의 최종결과에 대한 주식시장의 예측가능성을 통제한 후, 지식재산 분쟁의 결과가 소송을 제기한 기업의 기업가치에 어떠한 영향을 미치는지를 실증적으로 분석하고자 한다. 회귀분석 결과, 최종 판결의 결과를 예상할 수 있었던 경우에는 분쟁의 승패 여부와 상관없이 소송을 제기한 제 3자 기업의 기업 가치에 아무런 영향을 미치지않는 것으로 나타났으나, 최종 판결이 결과를 예측하지 못한 방향으로 이루어진 경우에는 유의미한 반응을 보이는 것으로 나타났다. 특히 지식재산권자가 패소한 경우에는 소를 제기한기업(지식재산권자 상대방 기업)의 주가는 양(+)의 초과수익률을 보이는 것으로 나타났다. 이는 최종결과에 대한 주식시장의 예상여부를 통제하는 것이 주식시장의 반응을 분석하는데매우 중요한 요인임을 의미하며, 지식재산권에 대한 불확실성을 제거하는 것이 기업의 가치에 중요한 영향을 미치고 있음을 나타낸다.
Abstract
A final decision on intellectual property dispute from Supreme Court gives financial markets new information about the concerned plaintiffs and patent holders. Financial markets respond to the news and revaluate stock prices of both concerned parties. This paper contributes to literature analyzing what is the effects of the Korean supreme court’s decisions on intellectual property lawsuits exerted on plainfiffs’ market valuations. When the conclusion of Supreme Court is expectd, markets did not respond to the news release regardless of which party win in the dispute. But, when unexpected conclusion is released, markets react positively for plaintiffs in the case of their winning, whereas there is no significant effects in the case of their loses. The study suggests that controlling the market expectation is important to evaluate the associated firm's stock market performances.
