청소년 탈비행 과정에 관한 고찰: Sampson과 Laub의 생애과정이론을 중심으로

그동안 국내 범죄학계에서는 범죄와 비행에 영향을 주는 요인들을 찾아내고 이들을 억제하는방안을 마련하는데 상당한 관심을 기울여온 반면, 탈비행에 대한 체계적이고 심층적인 논의는다소 소홀히 했다는 비판에서 자유로울 수 없다. 본 연구는 이러한 문제의식을 토대로 탈비행에관한 선행연구들을 비판적으로 들여다보고 그 대안으로 Samson과 Laub의 생애과정이론과 관련연구 결과를 소개함으로써 소년범에 대한 장기적 사회격리 처우와 관련된 형사 정책적 함의를제시하고자 하였다. 선행연구들은 탈비행의 개념을 완전하게 정의하지 못하고, 측정방식의 합리성이 떨어지며, 연구기간이 상대적으로 짧고, 탈비행의 인과과정을 논리적으로 설명하지 못하는등의 단점들을 보여주었다. 이에 반하여 Samson과 Laub의 생애과정이론은 전환점적 사건들, 비행환경과의 단절, 일상 활동의 구조적 변화, 점증적 사회적 자본의 형성, 탈비행자의 주체성 등의개념을 중심으로 탈비행의 인과과정을 비교적 명확하게 설명했다. 결과적으로 생애과정이론은소년범에 대해서는 낙인, 처벌, 격리보다는 가족, 학교, 기타 사회제도와의 애착과 유대를 형성해줄 수 있는 탈비행 환경을 조성하는 정책이 보다 실효성을 지닌다는 점을 시사하고 있다.
Abstract
There has been a paucity of systematic review on the theories of criminal desistance process. The present study is an attempt to fill this gap in the literature. This review first addresses issues pertaining to the definition and measurement of desistance. It then proceeds to introduce a list of desistance theories that have been proffered in the Western countries. The current study focuses particularly on Sampson and Laub’s life-course theory, which is largely regarded as the most authoritative and definitive account of criminal desistance. A careful attention was given to the issues centering on turning points, knifing-off from crimInogenic environments, structural changes of routine activities, incremental formation of social capital, and the importance of human agency. We additionally commented on recent findings from neuroscience that dovetail well with the abovementioned issues. In terms of methodology, the importance of qualitative research was emphasized. Lastly, as a policy implication, we suggest that lengthy incarceration of adolescents could result in detrimental effects that effectively hinder successful desistance.
