초기 갈등관리를 위한 비선호시설 입지 관련 법제도 분석: 참여적 갈등관리방법을 중심으로

Initial conflict management is very important in terms of minimum costs and effective management in the field of conflict management. Initial conflict management is to capture initial conflicts and correspond promptly to initial conflicts. This study is to induce the necessity of initial conflict management based on theoretical backgrounds regarding conflict complexity, diagnose the current situation in initial conflict management using comparative analysis to legal institutions, and suggest improvement plans to strength of ability to conflict management. The analytical results are followings. First, the overall legal institutionalization level of participatory conflict management in the filed of initial conflicts is low. Second, an interactive communication in participatory conflict management merely influences NIMBY policy decision making process. Third, the result of this study reveals that legal institutions such as referendum and Site-specific Advisory Boards might cause proper participants problems because legal institutions might have a weakness regarding process of operation and communication ways. In overall, this study suggests that legal institutions should be reformed detailed and elaborately for enforcement of initial conflict management.
