의회와 행정부간 입법 권한의 헌법적 정립

행정입법에 대한 의회의 통제 문제는 행정권과 입법권 간 권한 다툼의 차원에 머무르는 것이 아니라, 입법이라는 헌법 활동의 가치적 본질을 탐구하는 작업을 통해 정당화되어야 한다. 행정국가로 정체성이 규정된 현대 사회에서, 법률 위임의 형식으로 제정되는 소위 ‘행정입법권’이 행정부에 전속한 것인지 입법부의 관여를 허용하는 것인지를 가리는 일은 그리 쉽지는 않다. 이는 민주주의의 정당성에 무게를 두느냐 행정적 국가 목표 달성에 더 큰 비중을 두느냐의 문제로 환원되며, 단지 선택의 문제일 뿐이라고 쉽게 단정할 수도 없고 정당성과 명분만을 일방적으로 강조할 수도 없다. 결국 헌법이 말하는 ‘입법’이란 본질적으로 무엇이며 누구를 위한 것인가의 문제를 해결하는 것이 행정입법 통제에 관한 해답을 찾아내는 과정으로 볼 수 있다. 헌법이 규정하는 ‘입법권’이라는 것이 본래 주권자인 국민의 것이지만, 그 실천이 대표에 위임되었고 더욱 세부적이고 전문적 사항은 다시 행정부에 위임되었다는 본질을 되찾는다면, 문제 해결을 위한 충분한 전제에 이를 수 있을 것이다. 이 글은 이러한 전제를 되찾기 위한 논변이다.
Abstract
The legislative control on the administrative rulemaking refers to the value and essence of rulemaking in general concept. It is not the matter of political power struggle from the factional level. Because rulemaking is a constitutional behavior of the constitutional organs, it should find its own justification from the constitution. The difficulty exists in the identity of the contemporary society that is covered with the wide variety of administration. We cannot live alone without the help of the professional policies of the executive. Therefore, it is not easy to choose the right position of the administrative rulemaking power. This matter can be viewed both from the democratic justification and from the administrative object fulfillment. Accordingly, to decide whether the legislature can control on the administrative rulemaking, we have to find an answer to the question of what the legislation is and for whom the legislation is under the constitution, first. The right of rulemaking is for the sovereignty, the people. And this right is delegated to the legislature. And the legislature delegates the right of administrative rulemaking to the executive. This plain facts provides the clue of the solution for this difficult matter.
