세대 간 정의의 헌법 규범화 방안― 미국과 유럽의 논의를 중심으로 ―

Intergenerational Justice has been dealt with by the constitutional academia so far, but we could not find a conspicuous leap in Korea. This article tries to theoretically restructure this issue and design a practical framework to discuss. Intergenerational justice is a sort of redistribution of wealth between the generations living in different timeline. In this circumstance, this article seeks to analyze the intergenerational justice theories and concretize them into a norm. In theoretical layer, it focuses upon philosophical foundations for intergenerational justice. Based on them, this article builds up a structure for reconstruction of its constitutional concept and suggests interpretive methods and legislative alternatives. The main purpose of this article is that we need to understand intergenerational justice in terms of constitutional rights. Most of all, this article provided a realistic model of the constitutional provision of intergenerational justice. The right of ecological life is a useful leverage for this purpose. Clean environment for the future generation and regulations on unjustified development were the main themes of this practice. Fiscal sustainability was also suggested for it. Based on this study, the writer hopes that further discussion will be made from every field of study including constitutional law.
