조선시대 법제사 관련 자료의 융복합적 접근과 민사소송
A complex approach at the literature related in the annals of legislation and Civil Procedure of Chosun Dynasty

초록
서지학은 주로 고서와 고문서 등 사적(史的)인 자료를 다루는 분야이다. 그러므로 모든 학문 분야의 연구와 관련된 복합 학문이라 할 수 있다. 조선시대법제사(法制史) 관련 자료의 접근 역시 역사적 자료를 통한 이해에서 시작되어진다. 이 글에서는 “조선시대 법제사 관련 자료의 융복합적인 접근”이라는 제목으로 법전(法典) 등 조선시대를 중심으로 법제사 관련 전적류의 대체적인 편찬과 간행 양상을 살펴보고, 조선시대 대표적인 민사 소송 고문서 자료인 소지(所志)의 여러 내용별 유형과 사례에 대하여 소개하였다. 이 중 가장 많은 것은 산송이었으며, 산송은 산소(山所)에 관한 송사(訟事) 를 일컫는 것으로 주로 명당의 자리에 묘 자리를 잡기 위해 일어나 조선 후기에 이르러 극도로 심화되었다. 산송의 대부분은 투장(偸葬)과 관련된 내용이었다. 산송이 지속적으로 진행되면서 그 과정 중 폭행과 살인 등 형사 소송까지발생하게 된 사례도 있다. 이러한 조선시대 법제사와 관련 사료는 시대적 자료의 편찬과 간행, 형벌과 제도의 변화, 법의 생성과 소멸, 각종 소송을 둘러싼 미시적인 접근 등 법제사 분야에서의 다양한 연구와 활용이 가능하다. 또한 고문서 중 특히 소지류를 통하여 거시적인 접근은 물론이거니와 미시적인 관점에서 인간과 인간 사이에서 벌어지는 다양한 갈등, 재판 과정 중 판결권자인 수령과 관찰사의 권력 행위와 뇌물, 청탁, 피고의 권력 행사 등 조선시대에 살았던 조상들의 삶과 법 등을 살펴볼 수 있다.
Abstract
Bibliography deal with old books, ancient document and historical materials. So the category is complex area extended in various scholarship. The studies in annals of legislation literature is also begun with understanding of historical materials as well. Therefore, this article tried to examine the trend of publication in the category of legislation literature in Chosun Dynasty. In addition, the study introduced various type and case of ancient document, that is representative one related civil suit. These historical materials related in legislation help the understanding in the area of compilation and publication tendancy of legislation literature, the penalty and the change of policy, the creation and disappearance of law so forth. Moreover, this article explores various legal conflicts, their resolutions and bribes, commissioning, misuse of judicial power in the trial procedure by examining ancient documents and historical materials.
