정현(淨賢) 박윤흔 박사의 행정법학 - 관료와 학자의 병행적 삶 속에서 꽃피운 실용학문 -

This paper explored the academic world and life of Dr. Yun Heun Park, Junghyun (pen name), and its ideas were disclosed in dialogs with the senior public law scholar. Working in the Korean Ministry of Government Legislation for more than a quarter of a century, he not only looked for the administrative law system suitable for the Korean reality and developed theories based on the Korean administrative reality, but also created unique academic traditions designing and introducing various systems and promoting legal and political debates. In this point of view, his administrative law can be called the practical study grown in the concurrent life of bureaucrat and scholar. In this paper, the preface (Chapter I) describes (1) life and academic journey of Dr. Yun Heun Park, (2) Dr. Park’s performance in the Korean Ministry of Government Legislation and (3) Dr. Park’s life credo. In the Chapter II titled the administrative law footprints of Dr. Yun Heun Park, the following 6 different periods were divided for study: (1) the preparation period of Dr. Yun Heun Park for administrative law: work in the Korean Ministry of Government Legislation and study in the USA (1961-1972), (2) the leap period of Dr. Park’s administrative law: the days of work in the Korean Ministry of Government Legislation as a legislative officer (1973-1978), (3) the maturing period of Dr. Park’s administrative law: the days of work in the Korean Ministry of Government Legislation as a high-ranking official (August 1978 through February 1988), (4) the completion period of Dr. Park’s administrative law: the days of teaching as a professor in the College of Law of Kyunghee University (1988-1993 and 1995), (5) the period of Dr. Park’s participation in reality: the days of service as the Korean Minister of Environment and the President of Daegu University (1994-1995 and 1996-2000), and (6) the expedition period of Dr. Park’s administrative law: after retirement in 2000. The chapter III describes the pointing spots of Dr. Yun Heun Park’s administrative law as (1) the practical administrative law suitable for solution of the Korean administrative reality, (2) the administrative law advancing to legislative and political levels surpassing the legal hermeneutics, (3) the theories developed suitable for the Korean reality and the comparative legal methodology based on the US legislative system, and (4) the administrative law in conjunction with the constitution. The Chapter IV titled the contributions of Dr. Yun Heun Park describes (1) publication of standard administrative law textbook, (2) pursuit of the practical law through development of theories for real issues and realization of systems: (i) the practical law reflecting administrative realities, (ii) formation of the cornerstone for the legislation pre-announcement system, (iii) contribution to introduction of the fine imposition system, and (iv) improvement of the administrative trial system, and (3) pursuit of harmony of public and private interests with various experiences. In conclusion, Dr. Yun Heun Park, Junghyun (pen name), greatly contributed to the country and society in the attitude of loyalty and patriotism doing best in given realities in the course of studying administrative law.
