법원 판례분석을 통한 체육수업 단계별안전사고의 원인 분석과 교사의 역할 모색

This study analyzed a cause of safety accident in physical education classes through judicial precedents of court, and provided materials to prevent the safety accidents round the phased flow of the physical education classes. The objects of this study were 8 judicial precedents of court concerning physical education classes among the safety accidents in the school. General components were sorted according to the phased of flow in judicial precedents after general components were found according to the phased of flow in 4 steps. The judgment, in legal terms, according to the phased of flow were re-analyzed from an educational point of view. The study consisted of 4 phases such as lesson plan, lesson introduction, lesson development, and lesson concluding according to the phased flow of the physical education classes. The results showed that confirmation of environmental considerations, regular course and notified class, and confirmation of safety on teaching places and teaching tools are important items a teacher should be noticed about in a phase of lesson plan. In the phase of lesson introduction, pre-confirmation of students requiring protection and weak students, and enforcement of sufficient and proper warming up were demanded as teachers’ duty of care. In the phase of lesson development, explanation of rules and precautions, conducting differentiated classes, quick emergency measures, and active supervision of a teacher in charge were matters that teachers should keep. In the last phase of lesson concluding, teachers should confirm announcement of class and post notice.
