초록
세계 각국의 주민분쟁해결제도에 대한 도입 추세는 지역사회의 분쟁해결을 위한 유행(popular)이라고까지 표현할 정도이다. 하지만 우리나라에서 Community Mediation 자체를 대상으로 하는 연구는 매우 드문 실정이다. 이제는 우리나라에서도 지역사회에서 발생하는 수많은 분쟁들을 갈등이나 분쟁의 초기 단계에서 해결해 줄 수 있도록 지역사회의 종합적인 분쟁해결 접근방법으로서의 주민조정(Community Mediation)제도의 도입을 검토해야 할 때다. 이 논문은 400여 개가 넘는 주민분쟁해결센터를 통하여 다양한 분쟁해결을 하고 있는 미국에서의 주민조정프로그램(Community Mediation Program)의 도입 배경을 비롯하여 그 발전과정과 현황을 살펴보고, 우리나라의 주민분쟁해결제도의 도입에 참고하고 도움이 되게 하고자 하는데 목적이 있다. 우리나라에서 주민조정센터의 설립을 통한 주민조정프로그램이 성공적으로 도입되기 위해서는 주민조정제도에 대한 대해 국민들의 인식 확산과 이에 대한 홍보, 다양한 재원 조달 방식의 모색, 법원이나 경찰서 등 사건 접수가 많은 기관과 주민조정센터와의 사이에 사건회부시스템 구축, 내실 있는 조정인 교육 등에 중점을 두어야 할 것이다.
Abstract
There are rare studies on Community Mediation in Korea.. Now is the time to consider the introduction of the community mediation system as a comprehensive dispute resolution approach that solves lots of conflicts and disputes in the early stages of them. This paper aims to examine the introduction background, development process and current situation of more than 400 Community Mediation Programs in the United States and to make helpful reference to the introduction of the Community Mediation system in Korea. In order to successfully introduce Community Mediation Programs in Korea, through the establishment of Community Mediation Centers, we should focus on their public awareness and publicity, groping of various financing resources, the establishment of the case referral system between Community Mediation Centers and the institutions with plenty of caseloads, including courts and the police, and fruitful mediators education programs.
