초록
긴급재정관리제도의 도입과 더불어 지방정부 파산제도에 대한 관심이 고조되고 있는상황에서 미국과 일본의 지방정부 파산제도를 고찰해봄으로써 우리나라 긴급재정관리제도의 도입관련 쟁점들에 대한 논의와 시사점을 도출하는 것이 본 연구의 목적이다. 일본의 재정재건제도나 미국의 지방정부 파산제도인 Chapter 9은 지방자치단체의 파산에 대한 조치의 성격보다는 파산을 방지하거나 지방자치단체의 재정위기 상황 극복을 지원해주는 것을 목적으로 하며, 지역주민들에게 지속적으로 최소한의 행정적 서비스가 제공될 수 있도록 지원하고 있다는 공통점을 지니고 있다. 또한 지방자치단체의 자치권을존중하여 스스로 재건계획을 수립할 수 있도록 지원하는 등 중앙정부는 감시 및 지원하되 기본적으로는 지방자치단체의 자구적인 노력을 강조하고 있다. 이러한 점을 고려하여 우리나라의 긴급재정관리제도도 운영상에 있어 중앙의 간섭과통제에 무게를 두기 보다는 중단 없는 행정서비스 제공과 지방자치단체의 자율성 및 자구노력에 초점을 두어 감시 및 지원역할에 집중하는 것이 바람직할 것으로 생각된다.
Abstract
The interests of Municipal bankruptcies are increasing with the instruction of a Financial Emergency Management System(FEMS). Under this situation, the purpose of this study is to draw the discussion and the implication of the issues related to that by reviewing US & Japanese municipal bankruptcies. Both of Japanese financial recovery system and US municipal bankruptcy Chapter 9 are rather to prevent municipal bankruptcies or to help the recovery of municipal financial crisis than just simply take care of the bankruptcy itself, so they can provide the basic administrative services to the communities consistently. They monitor or support the municipalities to create the plan for financial restructures by stressing municipality’s self- recovery effort. Considering these, in running FEMS in Korea, it is desirable to monitor and support for providing sustainable administrative services and municipality’s autonomous & self-recovery effort than interfere and control from the state.
