선박교통관제의 법제 개선방안에 대한 고찰

초록
선박교통관제는 해상교통으로 인해 야기될 수 있는 연안해역에서의 항해 안전성과 효율 성, 해상인명구조 및 해양환경보호 등을 향상시키고 항내 및 항로에서의 해상교통관리를 강 화시키기 위한 수단으로써 전 세계 여러 주요 항만과 수역에서 이용되고 있다. 현재 각 국에 서는 VTS에 관한 국내법을 제정하여 자국연안에서의 선박통제제도를 시행하고 있다. 이는 국제해사기구가 1997년 11월 27일 채택한 SOLAS 협약 제5장 12규칙과 VTS 지침을 근거로 하고 있다. 우리나라도 국내법으로 선박교통관제에 대한 규정을 두고 있으며, 국민안전처에서 운영하 고 있다. 하지만 이는 세월호 사고의 여파로 해양경찰이 해체되고 국민안전처로 통합되면서 갑작스럽게 선박교통관제가 일원화되는 과정을 겪은 결과이다. 결국 갑작스럽게 이루어진 대 대적인 조직개편에 따른 선박교통관제의 일원화는 법률적 정비가 뒷받침되지 못하고 있으며, 실무에서 혼선을 가중시키고 있다. 이에 이 논문에서는 해양수산부에서 국민안전처으로 이관된 선박교통관제에 대한 실무적 인 문제점을 검토하고 법률적 개선방안을 제시하고자 한다.
Abstract
Vessel Traffic Services are shore-side systems which range from the provision of simple information messages to ships, such as position of other traffic or meterological hazard warnings, to extensive management of traffic within a port or waterway and improve the safety and efficiency of navigation, safety of life at sea and the protection of the marine environment and/or the adjacent shore area, worksites and offshore installations from possible adverse effects of maritime traffic. Nowadays a service established national law and implemented by a competent authority of various countries of the world. VTS is governed by SOLAS Chapter V Regulation 12 together with the Guidelines for Vessel Traffic Services [IMO Resolution A.857(20)] adopted by the International Maritime Organization on 27 November 1997. At present, there are two national laws about VTS and administrated by the Ministry of Public Safety and Security in Korea. However, as a result, Korea Coast Guard was dismissed and integrated into the Ministry of Public Safety and Security in the aftermath of Sewol ferry incident in Korea. Also, Vessel Traffic Services were unified into the Ministry of Public Safety and Security. But nothing is done to modify laws and regulations in a related development. Therefore, we study the problems that Vessel Traffic Services have been transferred from the Ministry of Oceans and Fisheries to the Ministry of Public Safety and Security and suggest the legal improvements about that.
