공익사업 환경변화에 따른 손실보상제도의 개선과제

Various public works that were planned in accordance with the national land development plans since the 1970s such as social infrastructures (SOCs), industrial complexes, new town developments, housing developments, etc. served as the foundation for economic development. However, serving as the foundation for a compressed economic development, public works were carried out on a full-scale expropriation basis which facilitated the securing of low-priced land and prompt progress of the project due to the special nature of the financial conditions. This continuously raised issues of social conflict and controversy regarding infringement of property rights. The reason why such project method was relatively accepted was because there was a national consensus regarding the public good or interest. However, as Korean society accomplished a level of economic development similar to developed countries and the Korean people gained greater awareness regarding property rights, it is no exaggeration to say that the old ways of carrying out public works had encountered its limitations. As a result, future public works would only become possible if they were carried out in a way that it could respond to environmental changes. The purpose of this study is to examine the environmental changes caused by public works and to make policy proposals regarding future tasks to help improve upon such issues. In chapter II, this study considers the environmental changes caused by public works. In chapter III, this study review and examines the need to modify the land compensation system regarding environmental changes caused by public works and chapters 4 and 5 makes proposals regarding tasks to help improve the land compensation system regarding environmetal changes caused by public works.
