가습기 살균제 사건의 민사적 쟁점: 제조물책임과 인과관계 입증

가습기살균제를 사용함으로써 손해를 입은 피해자들은 현재 가습기살균제를 제조 및 판매한 업체를 상대로 손해배상소송을 진행하고 있다. 가습기살균제 사건은 고도의 기술이 집약되어 대량으로 생산되는 제품의 결함으로 인하여 피해자에게 손해가 발생한 사안으로 일반불법행위책임의 특칙이라고 할 수 있는 제조물책임법이 적용된다고 할 것이다. 우리 법원은 제조물책임법 제정 이전부터 제조물책임적 성격을 갖는 일련의 사건들에서 제조물의 결함에 대한 제조자 등의 과실 및 결함과 손해 사이의 인과관계를 추정하여 피해자의 입증책임을 완화함으로써 피해의 구제를 모색해 왔다. 그러나 법원은 일부 사례에서 제조물책임법상, 결함을 ‘제조상의 결함’, ‘설계상의 결함’, ‘표시상의 결함’으로 유형화하고 있다고 하면서 ‘설계상의 결함’ 및 ‘표시상의 결함’의 경우는 과실책임으로 해석된다고 판단하고 있다. 이는 결국 피해자가, 제조자가 결함의 존재를 알았거나 알 수 있었을 것이라는 사실을 입증해야하는 것으로서 일반불법행위책임과 실질적으로 차이가 없는 것이라 할 것이다. 제조물책임법의 영역에서도 사실적 인과관계, 즉 결함으로 인하여 손해가 발생하였다는 사실이 입증되어야 하는 점은 일반불법행위책임에서와 다르지 않다. 그리고 그러한 제조물책임에서는 특히 역학적 인과관계의 적용여부가 문제되고 있다. 우리 대법원은 역학적 관련성이 인정된다고 하더라도 곧바로 개별적 인과관계까지 인정되는 것은 아니라고 하고 있기 때문이다. 또한 대법원은 특이성 질환 혹은 비특이성 질환을 구분하여, 특이성 질환의 경우 역학적 상관관계로 인과관계를 인정할 수 있지만 비특이성 질환의 경우는 역학적 상관관계가 있다는 것만으로는 개별적 인과관계를 인정할 수 없다고 하고 있다. 그러나 이러한 법원의 논리는 상당한 비판을 받고 있다. 특이성 질환 및 비특이성 질환의 구분은 학문적 근거가 없는 것이고 법원에서 말하고 있는 ‘하나의 병인에 의하여 발생’하여야 한다는 것과 ‘병인(원인)과 질병 발병(결과)이 명확하게 대응’하여야 한다는 요건을 갖추는 특이성 질환은 존재하지 않는다는 이유 때문이다. 우리 법원은 환경소송 및 제조물소송에 있어서 이른바 인과관계 입증 완화 법리를 채택함으로써 실질적인 피해구제를 시도하고 있다. 가습기살균제 사건에서도 이러한 법리가 적용되어야 한다. 또한, 비록 법원의 인과관계 입증 완화 법리 채택여부와 무관하게 법관의 자유심증에 따라 판결이 내려진다고 하더라도, “감정인의 감정결과가 감정 방법 등이 경험칙에 반하거나 합리성이 없는 등의 현저한 잘못이 없는 한 이를 존중해야 한다”는 대법원의 입장에 비추어, 법원이 당해 사건을 판단함에 있어 역학연구결과 역시 증거로서 부정하지 말고 존중해야 할 것이다.
Abstract
The victims who have suffered or are suffering by using disinfectant humidifiers are now bringing some lawsuit against the companies made the disinfectant humidifiers and sold them. The case of Disinfectant Humidifiers should apply the Product Liability Act as the special rule of general torts because the damages in the case were caused by defect in the products were made up of high technology-intensive and mass production. The courts have sought relief against damage in series of cases related product liability through presumption of manufacturer's negligence and the cause-and-effect relationship between the defect and damage, before enforcing the Product Liability Act. But, in some cases, the courts said the Product Liability Act had the provision of the product-defect, and the provision classified as ‘defect in manufacturing’, ‘defect in design’, ‘defect in indication’. And the courts added that ‘defect in design’ and ‘defect in indication’ in the Product Liability Act were interpreted as negligence-liability. The theory of the courts meant victims eventually should prove that a manufacturer was ware, or should have been aware, of the fact of the product-defect. And that means no difference with general tort-liability. The cases are subject to the Product Liability Act should prove the fact that the damage occurred owing to the product-defect, so-called cause-effect relationship, along with general tort-liability. In the product liability, particularly, it is a matter of whether or not epidemiological causal relationship is applied. The Supreme Court, in Korea, said the epidemiological relevance did not mean acknowledgement of individual causal relation. While the Supreme Court distinguished between specific and non-specific diseases, the Court also said the epidemiological correlation as a individual cause-effect relationship could be accepted only on occasions of specific diseases. The criteria for a specific disease pointed out in the Supreme Court Ruling of the Agent Orange Lawsuit are as follows: 'stemming from one etiology' and 'a clear correspondence between pathological cause and effect'. The theory of the Court, however, has been criticized for some reasons. First, the dichotomy of specific and non-specific diseases is devoid of a scientific foundation. Second, if a specific disease were to be defined as a disease having necessary and sufficient conditions stemming from a single cause, such a specific disease cannot exist. Many courts in courses of judgement have tried to actually relieve damage by alleviating, for victims, the burden of proof in the environmental lawsuits and product-liability lawsuits. The court should keep such the effort to alleviate the burden of proof in the case of Disinfectant Humidifiers. A court should also respect the result of epidemiological study as a evidential data in court, as the result of judicial appraisal does except having obvious errors, even if it judges with free evaluation of evidence.
