주민감사청구제도의 실효성 제고를 위한 감사위원회 설치에 관한 소고

초록
이상 일본 지방자치법상 감사위원감사제도를 검토하고 우리에게 주는 시사점을 살펴보았다. 다양한 감사, 과도한 감사, 중복감사 등의 문제를 해결하기 위한 일 측면에서 감사 담당 주체의 입장에서 개선방안을 제시하는 것이 본 논문의 목적이다. 우리나라에 있어 서울특별시, 광주광역시, 세종특별자치시에서 ‘감사위원회 구성 및 운영에 관한 조례’를 제정하고 시행중에 있다. 서울특별시 동 조례는 공공감사에 관한 법률 제5조 및 제6조, 같은 법 시행령 제4조, 지방자치법 제116조 및 같은 법 시행령 제79조에 따라 공정하고 투명한 감사 행정 구현을 위하여 현행 제1부시장 산하 독임제 감사관제도를 시장 직속의 합의제 감사기구인 ‘서울특별시 감사위원회’로 재편하여 온정주의적 감사라는 지적을 극복하고 독립적이며 전문적인 감사 집행이 이루어지도록 하고자 한다. 조례 제정 및 시행을 통해 감사위원회제도 도입을 한 마당에 효율적인 운영과 제도의 정착을 위해 다음의 점이 고려되어야 할 것이다. 1. 일본의 경우 독임제 집행기관 측면에서 감사위원감사 제도는 규모를 고려한 검토도 필요하다는 지적이 있다. 다양한 규모와 종류의 지방공공단체가 있는 가운데 동일한 감사 방법이나 절차가 일률적으로 채택될 필요는 없기 때문이다. 그러한 경우 방법이나 절차가 다른 각각의 감사를 정하는 일도 있을 수 있다. 제도의 상시 검토를 통해 자치단체별로 적합한 감사제도를 발굴하여야 할 것이다. 2. 일본의 경우 상설집행기관에서 비상근의 감사위원 기관설계가 가능하다 하고 있으나, 상근 감사위원은 불가결하다고 판단된다. 왜냐하면 상설 집행기관으로써 기능하지 않으면 판단기관으로서도 기능할 수 없기 때문이다. 3. 일본의 감사위원감사는 전원일치 합의의 결의방법을 채택하고 있으며 나름의 장점이 존재한다. 그러나, 감사의 실효성을 높이기 위해서는 감사결과의 보고 및 이에 덧붙여 제출할 수 있는 의견의 결정에 대해서는 다수결에 의할 수 있는 것으로 하고, 소수 의견을 부기해 공표하는 것이 적당하다. 이러한 방안에 따라 개개의 감사위원의 관점도 명확해 지고, 감사의 투명성 확보에도 이바지할 수 있을 것으로 기대된다. 4. 법적 안정성을 위해서는 자치단체 등의 규모 대소에 관계없이 동일한 법령에서 규제하는 것이 바람직하나, 감사에 대한 사회의 기대가 커뮤니티의 크기에 의해 다를 수 있다는 점도 유념하여야 한다. 만일 규모에 의해 주민의 감사에 대한 기대나 감사인의 관점이 다르다면 대규모 단체를 모방하기만 하는 것이 아니라 유연한 감사대응이 가능한 감사제도도 필요할 것이다. 5. 마지막으로 감사제도 자체의 내부통제 및 감사의 주된 기능이 관료기구와 공공부문의 감시 및 감독이라 한다면 구성에 있어서 시민통제의 원칙이 반드시 적용되어야 할 것이다. 한편, 우리의 경우에 있어 주민감사청구제도의 결과를 확인하기 쉽지 않은 실정인바, 그 결과를 가장 쉽게 공표할 필요성 및 방안이 마련되어야 할 것이다.
Abstract
By the Residents’ Voting ․ Request for Establishment ․ Revision or Abolition of Municipal Ordinance ․ Residents’ Request for Inspection ․ Residents’ Lawsuit ․ Summons by Residents, The purpose of this Act is to promote democracy and efficiency of local autonomous administration and to ensure balanced development of local areas and democratic development of the Republic of Korea, by prescribing matters concerning types, organization and operation of local governments, and basic relations between the State and local governments. but, the Effectiveness of Residents’ Request for Inspection system is low. there are many problems such as Matters concerning the objects, proposers, requirements for proposal, procedures, etc. of the Residents’ Request for Inspection. Request for Inspection system is a means of control to enhance fairness and responsibility in local autonomous administration through resident participation. Effective Request for Inspection system can be achieved with trustworthy external expertise's participation. For this, an independent permanent organization can be established. Professional auditing committee system, which has a judgment for a local government’s self-inspection and resident’ audit, can be also established from expanding an advisory committee of audit and resident’ audit council such as Japan. I focus on subjects of Request for Inspection, that is the competent Minister or the Mayor/Do Governor. and suggest of the improvement on the Installing Auditing Committee to enhance the Effectiveness. and refer to the Auditing Committee of Japan Local Autonomy Act. It is necessary to establish auditing committee as an independent permanent organization. by the auditing committee such as Germany, the United Kingdom, America, and France is introduced, the auditing committee received orders from the competent minister or mayors and governors will be unnecessary under the current enforcement ordinance of the Local Government Act. Seoul, Gwang Ju, Sejong city's Auditing Committee Municipal Ordinance shall enter into force. to this Auditing Committee Municipal Ordinance, the Auditing Committee of Japan Local Autonomy Act is good example.
