박은정(인제대학교)

57호, 135~157쪽

초록

Is it possible to apply the Industrial Accident Compensation Insurance Act to “Persons in Special Types of Employment” except 6 jobs provided in the Enforcement Decree of the Industrial Accident Compensation Insurance Act §125 providing the concept of “Persons in Special Types of Employment”? This paper started from this question. To answer this question, try to check the provisions about “Persons in Special Types of Employment” and analyze it critically. In its final analysis, this paper would contend that the Industrial Accident Compensation Insurance Act should be applied to “persons who need protection from occupational accidents because they are not covered by the Labor Standards Act, etc. even though they provide labor services in a similar way to workers regardless of type of contract.”
