공직선거법상 미래유권자의 선거참여 도입 방안 - 캐나다의 학생투표 사례를 중심으로 -

이 연구에서는 미래 유권자인 학생들에 대한 체험적 선거교육인 캐나다 학생투표 프로그램의 도입 및 실시 현황을 소개하고 실제 선거기간 동안 실제 후보자를 대상으로 하여 투표를 실시하는 학생투표 프로그램이 참여 학생과 교사, 그리고 부모에게 미치는 긍정적 성과를 살펴본다. 그리고 이를 한국에 도입할 경우 낮아지고 있는 젊은 세대의 투표율을 제고하는데 기여하고 학교 현장에서의 민주시민교육 확충에도 기여할 수 있는지를 중심으로 그 기대효과도 고찰해 본다. 학생투표는 그 성격상 모의투표로서 현행 법령상 선거여론조사에 해당하는데 이를 한국에 도입하려는 경우 먼저 현행 공직선거법 하에서 도입이 가능한지를 먼저 검토하고 필요한 공직선거법 개선방안을 살펴본다. 아울러 학생투표 실시와 관련된 법적 고려사항으로서 교육의 정치적 중립성 문제와 여론조사 결과공표 제한에 관한 내용을 함께 검토한다. 한국의 현행 공직선거법 하에서는 선거일 전 약 2개월의 기간 동안 투표용지와 유사한 모형을 활용한 여론조사를 실시하는 것을 명시적으로 금지하고 있으므로 캐나다에서 실시되는 방식 그대로 학생투표를 한국에 도입하는 것이 지금은 현실적으로 어렵다고 할 것이다. 하지만 장기적인 안목으로 미래 한국을 이끌어나갈 젊은 세대의 선거 참여를 제고하고 청소년에 대한 민주시민교육 확충에도 기여하는 효과적인 방안이 될 수 있는 학생투표 프로그램에 대해서 향후에 시대와 정치 상황에 따라 실시 시기와 방식 등 그 세부적인 내용은 다소 수정하더라도 프로그램의 도입 자체에 대하여는 적극 검토해야 한다고 본다.
Abstract
This study examines Canada’s Student Vote Program through which elementary and secondary school students receive an experiential education on elections by voting for actual candidates in a mock election held during the run-up to actual elections, and looks at the positive effects of this Program on students, teachers and parents. The study then reflects upon the potential benefits of introducing a similar program in Korea, in terms of reversing the trend of low voter turnout among younger Koreans, and in providing a more robust civic education in Korean schools. By nature, Student Votes would be regarded as mock elections that are classified as election opinion surveys under current Korean law. This paper therefore looks first at whether the current Korean Public Official Election Act would allow for the introduction of such a program, and then discusses possible improvements to current legislation that would be conducive to implementing a similar program in Korea. The issues of political neutrality in education and the current restriction on publishing opinion survey results are also dealt with in the context of Student Votes. The current Korean Public Official Election Act explicitly prohibits opinion polls from utilizing anything that resembles the actual ballot during the 2 months preceding any election. It would therefore not be possible, in the current legal environment, to simply bring over the Canadian Student Vote Program in its entirety. In the long term, however, it would serve Korea well to consider - when the timing and political circumstances are ripe - introducing a Student Vote Program with details and a timeline that are adapted to the Korean context, as an effective means to increase future generations’ participation in elections and contribute to a richer civic education for Korean youth.
