이 논문은 뉴욕 지역 한인 사회에서 법률 서비스를 제공하고 있는 한인 변호사들의 ‘무료법률서비스’ 또는 프로 보노 서비스(pro bono service)를 통해 한인 변호사들의 직업적 정체성 및 종족성의 재정의·재구성과 시민권에 대한 상상과 실천의 일면을 살펴본다. 이 논문은 2000년대 초반 뉴욕 지역에서의 참여관찰과 심층면접으로 이루어진 민족지적 연구에기반하고 있다. 한인 이민사회에서 미국 주류사회에 진출하는 데 선도적 역할이 부여되는한인 변호사들의 무료법률서비스는 이민 집단의 특성에 대한 이해와 태도가 중심이 된다. 변호사들의 무료법률서비스의 의미는 한인이라는 것, 법률전문직(legal professional)이란 것, 이민자 출신으로서 미국시민이 되는 것 등의 다각적 측면들이 복합적으로 얽혀 있다. 이 연구는 무료법률서비스를 소수민족 변호사들의 직업적 지위 및 정체성, 종족관계에 대한 갈등과 협상이 소수민족으로서 미국에 속하고자 하는 문화적 시민권 실천의 문제로서 나타나는지점으로 바라본다. 한인 변호사들의 무료법률서비스 양상은 이민사회에 대한 변호사들의소명의식과 책임감이 현실적 제약 속에서 단편적 또는 간헐적으로 실현되는 기회이기도 하고 이상적인 법전문 프로페셔널의 모습에 다가가는 길이기도 한다. 한인 변호사들의 무료법률서비스를 둘러싼 갈등과 협상은 한인 사회와 주류사회의 경계를 만들고 해체하고 넘나들면서 직업적, 종족적 의미를 재구성하는 모습을 담고 있다. 그런 의미에서 한인 변호사의 무료 법률서비스는 소수민족 변호사가 이민자들과 미국 제도 사이의 간극을 가로지르는 노력을 표상하며 궁극적으로 소수민족에서 미국 시민권으로 가는 중간 지대로 나타난다
Abstract
This article examines Korean American legal professionals' “free legal service,” or pro bono service, by which they redefine themselves, reconstitute their professional and ethnic identities, and find themselves to imagine the ways of obtaining and practicing U.S. citizenship. The research is based upon an ethnographic study which consists of participant observation and in–depth interviews carried out in the New York City area during the early 2000s. The New York Korean community’ s discourses often remind Korean American lawyers of their leadership role in assisting co–ethnic immigrants to join the mainstream society. However, Korean American lawyers’ free legal services are shaped by their own understanding of the nature and character of the immigrant community. Free legal service activities are connected with various meanings such as being Korean American or a legal professional, and an immigrant’s becoming a U.S. citizen. This study locates free legal services in the context in which Korean ethnic lawyers negotiate their professional membership and status, as well as their ethnicity. Through free legal services, they experience short–lived moments of fulfilling their professional and ethnic duties and realizing an idealized model of the legal professional, despite the constraints of real life. The lawyers’ conflicts and negotiations with free legal services reveal how they deconstruct and reconstitute the boundary between the Korean ethnic community and the mainstream society. Therefore, free legal service provided by Korean American lawyers symbolizes their efforts to cross over the division between an immigrant community and U.S. mainstream institutions, and it emerges as a pathway towards U.S. citizenship.
