일본의 의료사고 조사제도의 정비와 시행에 관한 고찰 - 우리나라 환자안전법의 하위법령 제정에 대한 시사점을 중심으로 -

초록
우리나라는 환자의 안전 확보와 의료의 질 향상을 위하여 2015. 1. 28. 환자안전법을 특별법으로 제정하였고, 2016. 7. 29. 그 시행을 앞두고 있다. 그러나 우리나라는 아직 환자안전법의 요건을 구체화하기 위한 하위법령이 제정되지 아니한 상태이다. 우리나라와 비슷한 시기에 일본에서도 2014. 6.경 의료법 개정을 통하여 환자안전을 위한 제도로 ‘의료사고 조사제도’를 도입하였고, 2015. 5. 8. 의료법시행규칙을 일부 개정하여 제도를 구체화하여 2015. 10. 1.부터 시행하고 있다. 일본의 의료사고조사제도는 환자안전 보고체계에 있어 의무적 보고 체계를 분류된다. 그리고 일본의 경우 그 보고대상 사고도 사망사고로 한정되어 있으며, 유족에게 조사의 개시와 결과에 대한 설명을 해야 한다. 반면 우리나라의 환자안전사고 보고제도는 자발적 보고 체계로 분류되어 체제상 차이점이 있다. 또한 보고대상인 환자안전사고가 사망사고로 한정되어 있지 않으며, 환자에 대한 설명이 의무화되어 있지 않다. 따라서 일본의 의료사고 조사제도라는 법제가 우리나라 환자안전법에 직접적으로 영향을 미치기는 어려울 것으로 보인다. 그러나 일본의 법제화 과정이나 제도의 중요 요건, 자료의 활용에 관한 방법 등은 우리나라의 환자안전 관리체계의 수립에 시사하는 바가 적지 않다.
Abstract
In Korea, to assure patients' safety and improve quality of health care services, the Patient Safety Act was enacted as a special law on 28 January 2015, and the act will take effect from 29 July 2016. However, subordinate laws of the act have not been legislated yet. In Japan, to improve safety of patients, medical malpractice investigation system was introduced since revision of the Medical Service Act in June 2014, and the system has been implemented from 1 October 2015 since enforcement rules of the Act were revised on 8 May 2015. Medical malpractice investigation system in Japan can be categorized as compulsory report system. Accidents that one should report are limited to those related to death, and one should notify relatives and family of the decreased of the commencement of the investigation and the result. On the other hand, the Korean system is categorized as voluntary report system. Accidents that one should report are not limited to death, and there is no regulation on duty of notification. Thus, the Japanese system cannot be directly applied to the Korean system. However, legislation process, important components of the system, and methods to utilize relevant materials can suggest important strategies for establishment of the patient safety assurance system in Korea.
