여성인권보장의 구체화 검토 – 대구시 양성평등기본조례를 중심으로 -

The constitution stipulates gender equality in various fields. Provisions of gender equality in the constitution can be interpreted as an intention to ensure gender quality. Also, various efforts of many scholars resulted in constitutional obligation of the state to realize equality in all areas of the society by law and order, instead of simply preventing unfair discrimination from the government. However, current constitutional provisions including Article 11 demand gender equality in separate fields and, therefore, do not provide unified and fundamental solutions to gender inequality. Although it is possible to find constitutionality in active measures to realize gender equality in the current constitution, the wording only prohibits discrimination based on gender in a passive manner. Also, the constitution implies that women should be treated equally to men and protected by men, simultaneously, it inherited gender stereotypes and separation. Therefore, it is necessary to reinforce legal ground for gender mainstreaming, by re-establishing the concept of gender equality from the gender perspective and specifying obligations of the state to actively implement gender equality. In that respect, this study reviewed specific provisions for gender equality policy defined in the ordinance of Daegu and proposed plans to improve them. The findings in this study can provide direction for other cities to improve their respective ordinances, by proposing consistent definition of various laws related to gender equality policy and examining relationship between different ordinances.
