「도시재생특별법」과 도시재생 관련법의 정합성 분석 연구

초록
이 연구는 「도시재생특별법」과 도시재생 관련 법률간 규정 내용의 부재, 충돌 등 부정합으로 인해 발생하는 문제점들을 살피고, 정합성을 제고하기 위한 법률 개선 방안을 도출하는 것을 목적으로 한다. 먼저 관련 규정의 부재(법의 흠결) 측면에서 첫째, 조세특례제한법의 개정작업이 동반되지 않아 도시재생사업자에 대한 조세감면이 불가능하고, 둘째, 조례에 의한 임대인의 지방세 감면은 법률유보 원칙에 위배될 여지가 있으며, 셋째, 도시재생활성화계획으로 의제처리 가능한 도시관리계획의 범위가 매우 제한적이어서 개별법에 의한 도시재생사업은 별도의 행정절차를 진행해야 한다는 문제점이 나타났다. 다음으로 관련 규정의 중복·충돌의 측면에서 첫째, 도시재생활성화지역 내 소규모 상업건축물 리모델링 사업은 건축법 등 관련법 간 충돌로 인해 작동하기 어려운 것으로 나타났으며, 둘째, 도시재생활성화지역의 상업지역·(준)공업지역 내 노후 주거지를 재생할 수 있는 수단이 부재한 것으로 나타났다. 위와 같은 문제점을 바탕으로 향후 도시재생정책 추진의 실효성을 제고하기 위한 법률 개선 방안을 제시하였다.
Abstract
The Urban Regeneration and Assistance Act is mainly concerned on ‘comprehensive assistatnce’ of urban regeneration project for lagging area. But revision of Urban Regeneration-related Law is not proceeded for now, that makes incoherence elements such as absence, overlap and conflict of regulations. So this study aimed at finding incoherence elements that occures between The Urban Regeneration and Assistance Act and Urban Regeneration-related Law, and providing policy implications. The paper finds that (1)Tax benefits are inapplicable to urban regeneration project operator because of incoherence between The Urban Regeneration and Assistance Act and The Restriction of Special Taxation Act. (2)Current urban regeneration policies on tax reduction for leaseholders who make an agreement for Fair Market Rents by ordinance, can be against the statute reservation principle. (3) Fictitious cases are restricted within narrow limits between Urban Regeneration Vitalization Plan and Urban Management Plan. (4)It is hard to activate the remodeling for small-sized commercial building in Urban Regeneration Vitalization Area because of conflict of related regulations. (5)There is no regeneration scheme at law for declined residential area in commercial and manufacturing area.
