어업생산자단체로서의 영어조합법인에 대한 법적 소고

The competition between states regarding marine territory has been intensified day by day. Because of international agreements such as Korea-China FTA, Korea-China Fisheries Agreement, and Korea-Japan Fisheries Agreement, the competitiveness of fishermen is weaken. In case of individual fishermen, it would be rational to induce efficient businesses through organizations for the improvement of fishermen's competence and productivity, instead of individual correspondences. The Fisheries Incorporated Association has been established to take merits of a Fisheries Producers' Organization which is an independent fishermen's organization to improve the productivity of fisheries and also to protect their rights. The Fisheries Incorporated Association means a Fishers who intend to enhance productivity through collaborative management of fisheries and jointly conduct the sale, distribution, processing, or exportation of fisheries products, the business of agricultural and fisheries tourism and resorts, and other business, or Rural Community, and Food Industry may establish a fisheries incorporated association, the number of members of which shall be at least five. Even though the current conditions of domestic and foreign fishing industry are rapidly changing, the Fisheries Incorporated Association is quantitatively decreasing. It is pretty different from the expected improvement of competitiveness of the Fisheries Incorporated Association. Through the improved competitiveness of the Fisheries Incorporated Association, the overall competitiveness of fishing industry should be reinforced. For this, it would be necessary to research the legal nature of the Fisheries Incorporated Association, rights of members and semi-members, and creditor protection. So far, the review of the Fisheries Association Corporation was not sufficient. This study is expected to become a foundation to vitalize the Fisheries Incorporated Association, to develop our fishermen, and also to overcome domestic and foreign limitations in the aspect of fisheries management.
