초록
본 연구는 권력의 구성과 행사를 비판적으로 해부해 온 피에르 부르디외의 연구가 권력구조와 사회질서를 안정적으로 유지하는 기능을 가진 법을 연구하는데 어떠한 시사점을 줄 수 있는지, 또한 그의 사회학을 통해 어떠한 법사회학적 연구주제들이 가능한지 살펴보는 것을 목적으로 한다. 이러한 목적에 따라 본 연구는 그의 성찰 사회학의 이념이 법을 사회학적으로 연구하는데 어떠한 의미를 가지고 있는지 검토하고, 경험적인 연구를 위해 부르디외가 개발한 주요 개념들(사회적 영역, 장, 오몰로지, 아비투스 등)이 법과 권력의 관계를 연구하는데 어떠한 시사점을 주는지 살펴본다. 본 연구는 특히 그의 성찰사회학을 활용하여 현재 진행 중인 글로벌한 법률의 규칙의 재구성과 각 국 법률의장의 변화를 분석하는 이브 드잘레이와(Yves Dezalay) 브라이언트 가스(Bryant Garth)의 연구들을 소개함으로써 부르디외의 법사회학이 초국가적 법의 수출-수입 메커니즘의 경험적 연구에 어떠한 기여를 할 수 있는지 살펴본다. 끝으로 부르디외 법사회학과 경험적 연구들에 대한 몇 가지 비판들을 소개하고 여기에 대한 답변을 통해 최근 법률전문성의 국제적 순환을 다루는 이론적 쟁점에 보다 명확하게 접근하고자 한다.
Abstract
Pierre Bourdieu has critically analysed the (re)construction and the exercise of social power with his “sociologie de reflexion.” This study tries to examine his contributions to the critical sociology of law which focus on the power relations between law and state and legal professionals. For this purpose, I will examine the contribution of reflexive sociology to the social studies of law along with his research objectives, major concepts(social space, field, homology, habitus) and empirical studies. And in introducing recent studies of Yves Dezalay and Bryant Garth who analyse with Bourdieu's sociology the global legal restructuration and national legal reforms, I will explain the contributions of his sociology to the studies on the transnational legal import-export mechanisms. Finally, I will present some critical debates about bourdieusian sociology of law and its empirical studies in order to clarify the theoritical issues about transnational circulation of legal professionalism.
