초록
대상판결(대법원 2015. 7. 23. 선고 2015다200111 전원합의체 판결)은 형사사건에 관한 성공보수약정은 기본적 인권의 옹호와 사회정의의 실현을 그 사명으로 하는 변호사 직무의 공공성을 저해하고, 의뢰인과 일반 국민의 사법제도에 대한 신뢰를 현저히 떨어뜨릴 위험이 있으므로, 민법 제103조 소정의 선량한 풍속 기타 사회질서에 위반되는 것으로 판단하였다. 이는 성공보수약정은 원칙적으로 유효하고, 다만 그 적정성 여부만이 문제가 된다는 기존 판 례를 변경한 것이다. 한편 대상판결은 그 성공보수약정의 효력을 무효라고 하면서도 소급효 를 부정하고 대상판결 이후에 체결된 형사사건의 성공보수약정만이 무효가 된다는 장래효만 을 인정하였다. 이 글은 성공보수약정의 효력에 관한 외국 주요국가의 동향과 국내의 학설을 살피고, 민법 제103조의 법리를 검토한 다음에 대상판결의 정당성 여부를 살핀 것이다. 또한 장래효만을 인정한 대상판결의 논리적 타당성에는 의문이 있으므로, 이 문제도 논의의 범위에 포함시켜 점검하고자 한다.
Abstract
The verdict concerned(Supreme Court Sentence, Jul. 23, 2015, Case Number 2015Da200111) judged that promising a contingent fee for a lawyer in a criminal case violated a certain morality and other public order as defined in Article 103 of the Civil Act because it might impede public characteristics of a lawyer whose mission is to protect the fundamental human rights and realize social justice and run a risk of depreciating trust of the people on the judicial system remarkably. Such verdict changed current precedent which reads “A contingent fee for a lawyer is effective in principle but only its appropriateness matters” Meanwhile the verdict concerned judges that effectiveness of promising the contingent fee is invalid and its retroaction is denied but only the future effectiveness is recognized for the agreement on a contingent fee for a criminal case made after the aforementioned verdict. This study reviewed the trend of major foreign countries regarding the effectiveness of promising a contingent fee for a lawyer and the theories thereupon announced locally and also justification of the said verdict was reviewed after examining the legal principles of Article 103 of the Civil Act. Furthermore, as the logicality of the said verdict which recognized only a future effectiveness of such fee is questionable, this issue needs to be included in the discussion on this subject.
