한국의 홈리스(Homeless)문제 해결 방안에 관한 소고(小考)

초록
홈리스(Homeless)라는 개념은 국가마다 정치ㆍ문화의 환경이 다른 이유로 명확하게 정의하기가 어려운 측면이 있으나 우리나라의 경우 IMF 사태 이후 본격적으로 등장하기 시작한 이후 갈수록 젊고 근로능력이 있으며 다양한 직업군이 포함되고 있다는 점에서 서구의 홈리스와 비슷한 특성을 보이고 있다. 우리나라에서 겉으로 드러난 홈리스 발생의 직접적 원인은 실업문제다. 실업으로 인한 경제적 결핍이 가족관계의 약화, 주거생활의 불안정을 초래하였으며, 국가 사회보장제도가 안전망으로서 제대로 기능하지 못하는 상태가 지속되면서 홈리스생활은 피하기 어려운 선택이 되었다. 따라서 홈리스 대책은 그 발생을 사전 예방하는 것이 가장 중요하며, 그 과정에서 주거, 고용, 의료 등 사회보장정책 문제 등이 총체적으로 검토되어야 한다. 무엇보다, 홈리스 정책 입안과정에서 홈리스는 물론 홈리스를 돕는 시민단체의 의견을 경청할 필요가 있다. 이에 본 글은 미국과 일본의 최근 홈리스 정책을 검토한 후 우리나라의 현행 홈리스 관련 법제의 문제점과 그 개선방안을 검토하였다. 대강의 법제도적 개선점을 정리하면, ① 홈리스 정책 입안과정에서의 홈리스 당사자와 민간의 참여 보장 및 이를 위한 공청회 등 의견수렴절차 명시 ② 다양한 계층의 홈리스 대책을 위한 현행 법규상 노숙자 정의에서의 ‘18세 이상 나이 조항’ 삭제 ③ 홈리스 사전예방 내지 재발 방지를 위한 사회 주거안전망 구축 ④ 홈리스의 고용 알선 및 사회복귀 촉진 ⑤ 지방자치단체의 책임강화와 지역사회의 홈리스 대책 참여 ⑥ 홈리스 의료보호의 표준화 및 그 기초로서 홈리스 이용 대상 의료기관의 전국적 확대 ⑦ 시민단체와 종교단체 등 민간참여 촉진 및 그에 대한 정부 지원을 법률에 명시할 것 등이다.
Abstract
This study is purposed to suggest new definition of housing vulnerable groups and classification system for them by assessing the current ones which are officially used by the Korea government. In this research, the housing vulnerable groups signify households who are likely to experience degradation in terms of housing quality as they are unable to resolve their own housing problems for themselves. Based on the new definition, housing vulnerable people in Korea would include the following groups: rough-sleepers, people in accommodation, people in insecure housing, and people in inadequate housing. Consequently, the proposes that government should introduce new housing policy such as two-tiered housing safety-net and comprehensive supporting system to both homeless and non-homeless people. The reason of a homelessness is in individual or social defect. At present, there are many types of sleeping outdoors in our society. Policies for homeless people have built up and since the control of IMF at the end of 1997. But the current condition of homeless shelters in Korea is very insufficient for professional social work practice. We need to attempt to strengthen social support and network. Congress must improve 'Homeless Assistance Act'. And government have to be responsible for activities to assist homeless families and individuals. The major activities of the government policy: - Planning and coordinating the government's activities and programs to assist homeless people, and making or recommending policy changes to improve such assistance ; - Monitoring and evaluating assistance to homeless persons provided by all levels of government and the private sector; - Ensuring that technical assistance is provided to help community and other organizations effectively assist homeless persons; And disseminating information on country resources available to assist the homeless population. Our government should first accept that the misery of the homeless has resulted more from the ills of our society than their own faults. Like physically handicapped people, the homeless also deserve proper social care that would encourage them to go back to work and to their homes.]
