서구 국가사상의 수용과 건국헌법

이 글은 1948년에 제정된 대한민국의 건국헌법의 공공복리라는 개념과 구한말 국가유기체설과 연관성을 살펴보고자 한다. 공공복리는 국익(國益) 개념과 연결되기도 하는 국가의 전체성을 강조하는 개념이다. 전체성은 통일성을 강조하게 되고 그것은 개별성과 다양성보다는 획일성과 단일 의지를 중심에 놓을 수 있다. 구한말 국가위기의 상황에서 한반도의 지식인들은 난국을 타개하기 위해 서양의 정치학과 국가사상을 흡수했는데 그 중에 독일의 유기체적 국가론이 이러한 전체성과 통일성을 강조하고 있다. 개별 시민이 아닌 전체로서의 국민과 국가의 단일성이 강조되면 결국 시민사회의 이해관계나 시민 개개인의 관심사는 무시될 상황에 놓일 위험이 상존하게 된다. 공공복리 앞에서 개별이익은 그 목소리를 잃게 되는 것이다. 구한말의 국가사상은 쓰러져 가는 나라를 일으키기 위한 고민의 모습이 담겨있다. 건국헌법은 잃었던 나라를 되찾고 새로운 나라를 건설하기 위한 노력의 모습이 담겨있다. 구한말이나 건국기의 한국, 모두 국가가 제대로 확립되지 않았던 시기에 전체로서의 국민과 국가의 확립을 염원했고, 그 모습이 공공복리라는 이름으로 헌법에 나타난 것으로 파악할 것이다.
Abstract
This article aims at relating the public welfare concept of the Republic of Korea’s Founding Constitution in 1948 with the organic theory of the state in the late Chosun period. This public welfare leads to the concept of national interest afterward. The concept of public welfare and national interest highlights the wholeness, which emphasizes the unity and uniformity with a single will instead of individuality and diversity. Korean intellectuals impending national crisis of the late Chosun period would absorb western political science and state theory to break its impasse. one of those theories was the German theory of ‘organic state’ which emphasized the unity and wholeness of the state. If not individual citizens, but national unity and national people will be emphasized as a whole, the interests of the citizen or civil society lies eventually in a position to be ignored. In front of the public welfare, individual and common interests were to lose that voice. The state theory of the late Chosun period shows us the endeavor to raise a ramshackle country. The Founding Constitution shows us the efforts to build a new nation. All of Korea in the late Chosun and founding period is unestablished country. They long for the establishment of the national state and national people as a whole. And its reflection appears in the name of public welfare in the Founding Constitution.
