주요국의 재외국민보호에 대한 실효적 대응동향 - 특히 군의 역할과 관련법제를 중심으로 -

초록
최근 국제사회는 자연재해, 치안악화, 무력분쟁발생 등의 이유로 해외에 체류 중인 자국민의 생명이 위험에 봉착하는 경우 재외자국민의 안전확보를 위하여 재외자국민보호활동을 전개하고 있다. 일례로 리비아내전 시 주요국은 자국민의 안전을 확보하기 위하여 자국민이 체류하는 국가와 교섭을 갖고 사태가 악화된 경우에는 본국이 자국민을 국외로 탈출시키는 등의 조치를 취하였다. 다만 이때의 대응에 대해서는 국내에서의 상황판단과 행동개시의 결정, 실제 구조활동의 실행자, 각국과의 협력방법 등 다양한 문제가 관련되기 때문에 그 유형이 반드시 통일적이라고는 할 수 없다. 이러한 상황인식 아래 본문에서는 향후 해외자국민보호가 필요한 사태의 발생가능성을 염두에 두고 미국, 프랑스, 독일 등 주요국이 어떠한 형태로 해외자국민의 구출을 실시하는지, 즉 주요국의 재외국민보호에 대한 다양한 대응조치의 동향을 특히 군의 역할과 관련법제를 중심으로 재외자국민보호활동에 군부대를 사용하는 경우는 사태가 악화하여 민간수단으로는 재외자국민의 구출이 불가능한 경우로 한정되는 것인지 여부, 군부대의 출동 시 무장에 대하여는 상시 무기휴대를 허용하고 있는지 통상장비로 대처하는지 또는 사태에 따라 무장의 유무를 결정하는 것인지, 휴대무기의 사용에 대한 제한의 범위는 어떠한지, 군부대출동의 국내법적・국제법적 관련 근거는 무엇인지 등을 심도있게 분석・고찰함으로써 우리나라 해외체류국민보호의 실효적인 대응방안에 관한 시사점을 모색하고자 한다.
Abstract
Leading countries around the world started a protection activities on National Abroad for safety of National Abroad in foreign countries because of natural disaster, deterioration of public order and armed conflict. For example, in Libyan Civil War, leading countries, for protection of National Abroad, kept contacts with residence countries and took measures to escape its nationals abroad, if all conditions degenerated. But all measures took in those situations were not unified because they were related to estimation of the situation, decision of action, conductor of rescue activities and cooperation methods of related countries. I would like suggest an effective solution and implication by deep analysis and consideration whether how US, France and Germany rescued National Abroad, focused role of military and related legislation by taking into account both in using military for protecting National Abroad and not in using civilian actions, and whether related countries could carry arms and could treat usual equipment, and whether related countries decided militarization, when the use of carrying arm could be determined, what the domestic and international legal basis of mobilization of troops was.
