초록
본 연구는 글로벌 기업에 적합한 지식재산권(IP)제도를 적용한 디자인 프로세스를 제시한다. 21c는 지식정보화시대임과 동시에 지식과 정보의 생산, 분배, 사용을 기반으로 하는 특허, 상표, 디자인권과 같은 지식재산권의 자산화가 이루어지는 지식재산경영의 시대이다. 국가 경쟁력의 전략적 수단으로써 지식재산권의 가치와 비중은 더욱 커지고 있으며 또한 지식재산경영은 기업 간 경쟁력 우위의 기본이 되고 있다. 글로벌 기업의 기업적 가치는 디자인을 통해 차별화 경쟁력을 가지게 된다. 본 연구에서는 디자인과 지식재산권법의 제도적인 이해와 디자인관점에서의 지식재산권 활용 사례 조사를 통한 현황을 파악한다. 그리고 기존 디자인 프로세스를 되돌아보고 문제점을 제기한다. 나아가 기존 디자인 프로세스의 권리보호방안 결핍이라는 관점에서의 IP융합 디자인 프로세스를 제안한다. 글로벌 기업의 IP융합 디자인프로세스 활용 권장을 통해 기획 단계에서부터 잠재적인 분쟁의 소지를 최소화 시키며 차후 생기게 되는 분쟁에 대해서도 정당한 대응, 때에 따라서는 손해배상 청구를 가능하게 하는 기업의 디자인보호제도를 제시한다.
Abstract
This project presents a design process that is applied with the intellectual property(IP) rights for global companies. We are currently living in the information and technology centric society, and at the same time, the era of intellectual property management which intellectual property rights such as patents, brand, design rights are capitalized. The value of the intellectual property is becoming more significant for the strategy, which is used by different nations for their competitiveness and intellectual property management is the core of the companies in order to compete with others. The value of global companies is differentiated by the design. This study suggests institutional understanding of intellectual property law of design and the use of intellectual property rights in view of design. (And) to look back on the existing design process and pose a problem. Furthermore, this study suggests IP fusion process as the solution for the existing design process that lack in the rights protection plan. Promoting global companies to adopt fusion IP design process in order to minimize the potential dispute and also allowing companies to take proper action for any disputes or make claims if necessary.
