국가연구개발사업법 제정에 관한 검토

The domestic and foreign environments for science and technology have been changed and new legislative demands are necessary. National R&D sector also demand new legislative system. In regard of current national R&D issues, it is requested that law is readjusted as an infra of R&D system by solving incomplete establishment of legal structure in law and regulations of each concerning ministry, which are spread throughout each ministry. In this article, we suggest that new law which can generalize all of national R&D issues must be enacted. This paper treats some legislative implications about demand on reinforcement of the connection between national R&D policy and national science & technology policy in the process of establishing separate law in national R&D program, enhancement of the effect from strengthening of clarity and evaluation in selection process of R&D project, guarantee of autonomy and reinforcement of responsibility in research, and specialization of research administration through simplification and standardization of research administration process. And it also is covering with methodology that mediates issues related to the interest between concerning ministries. To solve the problem to 「Regulation on management of National R&D program」 which is having limitation in legal application as regulations of national science & technology policy originating from legal position of a decree, we changed its status into law, enabling it to perform its role as summative regulation of national R&D policy. Also we tried to arrange foundation for formation of connection between 「Framework Act on Science & Technology」. Finally, as a legislative research, we made and proposed legislative drafting of so-called "National R&D Projects Act" and legislative basis data. Also, we attempted to establish a model considering by foreign backgrounds in national science & technology policy and legal analysis. It can be helpful to have academic significance from the point that it accepted a literature methodology through various models used in social science to analyze national R&D law from the legal and functional perspective.
