초록
이 연구는 2012년 국회법 개정으로 40여년 만에 한국의회정치에 부활한 필리버스터에 대한 우려가 과장되었을 가능성이 크다는 인식으로부터 출발한다. 필리버스터에 대한 우려는 미국의 경험으로부터 전해진 것이기 때문에, 먼저 미국의 필리버스터의 역사를 살펴본다. 그 과정에서 현재 우리 국회법에 의해 법제화된 무제한 토론식 필리버스터는 현재 미국에서 그 부정적 기능을 염려하고 있는 필리버스터와 다름을 밝힌다. 지금 미국에서 논란이 되고 있는 새로운 형태의 필리버스터를 소개하고, 그 위험성에 대해 논의한다. 다음으로 미국에서 과거의 필리버스터라 정의되는 무제한 토론식 필리버스터가 진정으로 우려할 문제를 가지고 있는가에 대해 검토한다. 특히 미국 의회정치 과정에서의 심각한 문제로 인식되는 입법교착의 책임이 필리버스터에 있는가에 초점을 맞춰서 그 이론적 기반이라 할 수 있는 의회양극화 이론에 대한 비판적 논의를 진행한다. 또한 미국에서 필리버스터에 대한 우려가 커지면서 필리버스터 제도를 개혁할 기회들이 있었음에도 불구하고 좌절된 이유를 검토한다. 그리고 필리버스터가 계속 존속되는 이유를 상원의원들의 합리적 선택으로 설명해 본다. 마지막으로 필리버스터의 위헌여부에 대한 논란을 비판적으로 검토한 뒤, 국회법에 의해 한국 정치에 다시 등장한 필리버스터의 긍정적 역할을 모색해본다.
Abstract
This research starts from the perception that the concern about the filibuster revived by the National Assembly Act of 2012 is exaggerated. First, this essay looks into the history of American filibuster to understand its problems through the American experience. In the process, it is found that there is the difference between ‘talking filibuster’adopted by the Act and ‘stealth filibuster’currently abused and criticized in the U.S. Congress. And it is discussed that the ‘stealth filibuster’is more serious threat to legislature and representative democracy than the classical ‘talking filibuster.’Second, a critical analysis is made on the thesis that filibuster is responsible for legislative gridlock and legislative polarization theory which is the background of the thesis. Third, The cause of failure of filibuster reform is examined to find out the reason why filibuster keeps working and a positive side of filibuster. Finally, this research propose the lessen to be learned by Korean politics from American experience.
