대학 내 교수 성희롱의 법․제도적 방지책 수립을 위한 시론 - 예비적 고찰로서 성희롱의 유형화와 판단기준의 제안 -
A Preliminary Study on Sexual Harassment by Professors in Campus

본고는 현대사회에서 중대한 사회문제의 하나로 논의되기 시작한 성희롱의 문제를, 그동안 상대적으로 연구성과가 적었던 대학 내 교수 성희롱의 문제로 국한시켜 다루어 보고자 기획되었다. 우선 그 예비적 고찰로서 성희롱의 개념과 성희롱의 본질에 대한 두 가지 상반되는 관점을 검토해 본 후, 성희롱이 발생하게 되는 맥락을 여러 측면에서 분석해보고자 하였으며, 그 결과 ‘성차’, ‘성적 접근의도’, ‘권력관계(지배욕)’, ‘성차별’ 등의 맥락을 중심으로 네 가지 형태의 유형화를 시도해 보았고, 각각의 유형화된 사례에 있어서 일관되게 ‘합리적 여성’이라는 척도가 성희롱 판단의 타당한 기준으로 적용될 수 있음을 진화심리학을 원용해 입론해 보았다. 본고의 입론이 옳다면, 페미니스트 진영의 기본입장은 결과적으로 타당하지만, 극단적 형태의 기준, 즉 ‘개별 피해자 여성’이란 기준은 다소 완화될 필요가 있을 것이고, 평균적이고 중립적인 ‘합리적 인간’이란 기준은 적어도 ‘성적 갈등의 문제’에 관한 한, 그 타당성이 의심되며 따라서 ‘합리적 여성’ 기준으로 수정될 필요가 있다는 결론을 제시해 보았다.
Abstract
This paper analyzes not only the definition of sexual harassment but also the context and cause of several types of sexual harassment by professors in Campus and tries to suggest the standards of judgement of sexual harassment necessary for courts to decide the kinds of cases. Evolutionary psychological analysis opens the door for us to choose the standard of sexual harassment between 'reasonable person' and 'reasonable woman' standard. In conclusion, this paper argues the latter is more desirable when we legally evaluate a sexual conduct which seems to be a sexual harassment. Sexual harassment has been regarded as very severe social problem in our society, so, I believe, this preliminary study on sexual harassment will, and should be deepen in the next study. Next study treats the central issue, that is, the validity of criminalization of sexual harassment.
