의제강간죄 연령상향의 타당성에 대한 연구

의제강간죄의 연령을 상향하고자 하는 입법적 시도들이 있었다. 본 논문은 공식범죄통계와외국의 입법례, 청소년의 성적 동의 능력의 관점에서 의제강간죄 연령상향의 타당성을 검토한다. 먼저, 우리나라 연령대별 성범죄 피해자율과 가해자를 살펴보고, 성범죄 피해자율에 있어서는청소년들이 가장 높고 증가율도 가파른 반면에 가해자는 10대 뿐만 아니라 20대, 30대, 40대, 50대 이상 등 고루 분포되어 있어 성인에 의한 미성년자 성범죄가 많은 부분을 차지함을 공식통계를 이용하여 보인다. 외국의 입법례와 청소년의 성적 동의능력에 대해 살펴 본 다음 미성년자의성을 효과적으로 보호하기 위해 본 논문은 의제강간의 개선방향에 관해 논의한다. 청소년의 성을보호하기 위해 13세 미만으로 되어 있는 의제강간 연령의 상향을 제안하고 성인에 의한 미성년자의성착취를 막기 위해 가해자의 나이를 성인으로 제한할 필요가 있음을 언급한다. 또한 의제강간보호 대상 미성년자와의 성관계에서 미성년자의 나이를 잘못 알았다고 가해자가 주장할 때에는엄격하게 그 주장을 다루어야 함을 제안한다. 성범죄는 암수가 많은 범죄이고 최근에 성범죄범위가 넓어지고 있기 때문에 본 논문이 제안 이유로 삼는 미성년자 성범죄 증가율이 실질적인성범죄 현상을 반영하지는 못할 수도 있다는 본 논문의 한계와, 이론에 바탕을 둔 제안보다는국민들의 법감정을 조사하여 의제강간의 개선방향을 설정하는 것이 더 바람직하다는 앞으로의연구방향이 제시된다.
Abstract
There were several legal tries to raise the age in statutoty rape. This study examines the validity of age raise in statutory rape by using official crime data, comparing foreign countries' laws, and checking the youth's consent ability about sex. The analysis of the official crime data shows that the major targets of sex crimes are minors and many of them are victimized by adults, proposing that a policy to prevent minors from adults' sexual exploitation is needed. As the policy, this paper suggests the following three things related to statutory rape in Korea: First, the age of statutory rape which is 13 now, is needed to be raised, second, a perpetrator's contention that (s)he mistook as to age is required to be proved more carefully, and thirdly, it is recommended that perpetrators who are to be punished by statutory rape be adults. In conclusion, the limitations of this paper that the sex crimes have high dark numbers are mentioned with a future research direction.
