범죄예방을 위한 첨단과학기술 활용에 따른 법제도적 쟁점 고찰

초록
우리 사회가 고도의 정보화 사회로 발전해 나가는 과정은 여전히 진행 중이다. 그에 따라 우리의삶의 모습들도 매우 첨단화 되어가고 있다. 그처럼 우리사회가 첨단화 되어가고, 범죄예방에도첨단기술이 사용되는 것은 어쩌면 거스를 수 없는 대세일 수 있다. 그런데 법제도는 아직도 우리사회의 변화를 따라가고 있지 못하다. 특히 우리나라의 경우 더욱 그러하다. 이미 유럽이나 미국, 일본 등에서는 새로운 첨단과학기술들의 등장과 관련해서 다양한 연구들이 수행되어 왔고, 그를지원해 주기 위해서 다양한 법제도들이 마련되었거나 마련되고 있다. 그런데 우리나라는 이제겨우 관련 문제들을 인식하는 수준에 머물러 있으며, 규범적으로 논의되는 영역이 가이드라인이나시행규칙, 시행령이 대부분이다. 그와 같이 드론, 로봇, 빅데이터 등 첨단과학기술과 관련된 일반적인 법률들도 미흡한 상황에서범죄예방과 관련된 근거규정을 마련하기는 더욱 쉽지 않은 상황이다. 특히 해당 기술들은 개인정보와 밀접한 관계를 맺고 있다. 그러므로 범죄에 대한 수사목적과는 달리 범죄예방을 위해 해당기술들을 사용하는 것은 그리 쉽지 않은 상황이다. 다만, 그럼에도 불구하고 범죄예방을 위해첨단기술이 사용되기 위해서는 프라이버시 침해 방지, 첨단기술에 대한 보안강화, 첨단기술 운용에 따른 안전사고 방지에 대한 부분들을 관련 법률에 보다 명확히 규정할 필요가 있다. 더 나아가해당 기술을 사용하는 것이 기술적이나 법적으로 가능하더라도 자칫 국가에 의한 감시로 여겨져서시민들의 감정과 충돌할 수도 있다. 그러므로 범죄예방을 위해 첨단과학기술을 사용하는 문제는경험적인 연구와 시민에 대한 홍보 및 합의도출, 규범적인 연구가 융합적이고 종합적으로 이루어져야 할 필요가 있다.
Abstract
Our society is evolving into a highly information-oriented society. Thus, our lifestyle is also becoming very modernized. So, the trend that advanced technologies are used for crime prevention can be perhaps irreversible. But our legal system does not keep up with the change of our society. Europe, the USA and Japan already have performed a variety of studies with regard to law according to the new advanced technologies, so, they also have established a variety of laws. However, Korea has remained on the level of awareness of related issues only and it is being discussed only as guidelines, enforcement rules and implementing ordinances in the areas of law. Legislations associated with drones, robots, big data are also insufficient Therefore, it is even more difficult to establish regulations relating to crime prevention. In particular, these technologies have established a close relationship with personal information. So, the use of the technologies for crime prevention is not easy unlike investigative purposes. Nevertheless, it requires four elements roughly so that advanced technologies may be used for crime prevention - prevention of privacy infringement, enhanced security for high-tech, prevention of accidents on high-tech operation and acquisition of social credibility. Therefore, the issue regarding the use of advanced technologies for crime prevention needs to promote consensus building, to perform normative and empirical research, and to reduce errors of advanced technologies. The laws should be enacted for it as soon as possible.
