초록

1 現在、日本のゲーム市場は,スマホ・タブレット向け等のオンラインプラットフォームに主流が移っている中,ゲームにまつわる紛争に関する判例も相当数散見されるとともに,その他の法的問題,例えば,ゲーム内通貨等に関する資金決済法の問題,またいわゆる「コンプガチャ」に関する景品表示法の問題等が,報道されている。 2 最近のゲーム関連の判例は多岐にわたり,著作権を問題にするものが多数を占めるが,それ以外にも,不正競争防止法違反が問題となったもの,肖像権,パブリシティ権が問題となったもの,業務委託契約が問題となったもの,ゲーム製作の投資契約が問題となったもの等,様々なものが見られる。 3 ゲーム内通貨等に関する資金決済法の問題は,有償でゲーム内通貨を発行する場合に,一定の要件を充たすと,発行保証金の供託を義務付けられる等,ゲーム事業者にとって経済的負担を伴うものになる。 4 また,「コンプガチャ」に関する景品表示法の問題は,ゲーム内でレアなアイテムを取得するためユーザーが多数のアイテムを購入する等して多額の課金が発生する問題が多発し,社会問題になったこともあり,消費者庁が,一定の場合には景品表示法上のいわゆる「カード合わせ」の禁止に違反するとして,見解を発表するとともに,事業者団体も自主的に運用ガイドラインを発表している。 5 ゲーム業界はサービスの発展が著しいこともあり,今後も新たな法的問題が発生してくることが予想され,各法領域の基本的考え方を踏まえながら,妥当な解釈をしていく必要がある。

Abstract

1 Recently, in the Japanese game market, the mainstream of its format is transferring from package game into online platform mainly for smart phones and tablet devices. Under these circumstances, we can easily find out many court cases on game contents, and furthermore, there have been many news coverages on, for instance, issues of Payment Services Act related to in-game currency and issues of Act against Unjustifiable Premiums and Misleading Representations related to so called “Comp-Gacha.” 2 There are various kind of recent court cases related to game contents, most of which are those related to copyrights; provided, however, that there are also other kind of cases including those on a) Unfair Competition Prevention Law, b) portrait rights and publicity rights, c) game production service agreements and d) investment agreement for game production. 3 With respect to issues on Payment Services Act related to in-game currency, in case of issuing in-game currency for compensation, the game company issuing it shall be, under certain conditions, obliged to set aside issuance security deposit, which may burden the company with heavy economic strain. 4 With respect to issues on Act against Unjustifiable Premiums and Misleading Representations related to so called “Comp-Gacha,” many social problems have occurred since users of a game content got many items in order to get a rare item(s) and those situations caused heavy charges to some users. Therefore, Consumer Affairs Agency issued a guideline in which it construed that, under certain circumstances, games including “Comp-Gacha” shall be regarded as breach of prohibition from so called “card combination” under Act against Unjustifiable Premiums and Misleading Representations, and furthermore, some game trade associations voluntarily made public their operational guidelines. 5 Since growth and advancement of game services is significant in the game industries, new legal issues thereon will arise in the future, under which adequate construing of related laws and regulations shall be requied in accordance with basic concepts on current laws and regulations.
