2015년 혼인법 관련 주요 판례 회고

The year 2015 saw many matrimonial law-related precedents rendered, which may be summarized as follows. The Court has handed down the following five important judgments: (1) Supreme Court Decision 2014MU4734, 4741 Delivered on February 26, 2015 that sterility or sexual dysfunction does not gratify the grounds for the annulment of marriage stipulated in Civil Law Article 816-2; (2) Supreme Court Decision 2013MU2441 Delivered on May 29, 2015 that an illegal act committed by a spouse and the third party can be a joint illegal act against the other spouse; (3) Supreme Court Decision 2013MU568 Delivered on September 15, 2015 that blameful spouse may not sue for divorce in principle; (4) Seoul Family Court Decision Delivered on November 5, 2015 quoted from a fraudulent act revoked to preserve a claim for division of property; (5) Seoul Family Court Decision 2014DUDAN312270 delivered on July 17, 2015 on the acceptance and execution of a divorce decree issued in a foreign court. This study is to review the principal precedents established in 2015 in relation to matrimonial laws.
