외국계 대형마트 영업규제의 국제통상규범 합치성 문제에 대한 고찰: GATS와 한-EU FTA, 그리고 한-미 FTA를 중심으로

2012년 1월 17일 법률 제11175호로 개정된 유통산업발전법은 ‘지방자치단체장은 건전한 유통질서 확립, 근로자의 건강권 및 대규모점포 등과 중소유통업의 상생발전을 위하여 필요하다고 인정하는 경우 대규모점포(곧 대형마트)와 준대규모점포(곧 SSM)에 대하여 오전 0시부터 오전 8시까지의 범위에서 영업시간을 제한하거나 매월 1일 이상 2일 이내의 범위에서 의무휴업을 명할 수 있고 이들에 필요한 사항은 해당 지방자치단체의 조례로 정하도록 한다.’는 내용의 제12조의2를 신설하였다. 본 논문은 외국계 대형마트 영업규제의 국제통상규범 합치성 문제를 논하는 것을 그 목적으로 한다. 이를 위해 본 논문은 대형마트 관련 주요 규제와 주요 판결을 유통산업발전법 제12조의2를 중심으로 먼저 개관한 후, 2015년 11월 19일 선고된 대법원 2015두295 전원합의체 판결을 국제통상규범적 측면에서 살펴본다. 다음으로 본 논문은 외국계 대형마트 영업규제가 GATS, 한-미 FTA, 한-EU FTA 등의 국제통상규범에 위배되는지 여부를 검토하고 관련 쟁점을 논한다.
Abstract
Article 12-2 of the Distribution Industry Development Act provides that heads of local governments may order by ordinances superstores and quasi-superstores to restrict operating hours between 08:00 and 24:00 or suspend business by designating mandatory closing dates for not less than one day but not more than two days in a month, where deemed necessary for the establishment of sound distribution order, employees’ health right and coexistent development of superstores, etc. and the small medium distribution industry. The purpose of this paper is to analyze the consistency of such operation restrictions on foreign superstores with international trade law. The paper first introduces major regulations of superstores and major legal cases relating to Article 12-2 of the Distribution Industry Development Act. Then the paper examines the Supreme Court of Korea en banc Decision 2015Du295 on November 25 from the perspective of international trade law. Lastly the paper studies whether operation restrictions on foreign superstores are inconsistent with any international trade law, particularly GATS, Korea-EU FTA and Korea-US FTA.
