The CODE OF CIVIL PROCEDURE is composed of 6 books. The first book is provisions common to all courts, the second is provisions particular to each court, the third is provisions particular to certain subject-matters, the fourth is l'arbitration, the fifth is the resolution amicable of conflicts, the sixth is provisions related to the over-sea. The first book is composed of 22 titles. Here we discuss sub-title 1 and 2 of the title 7 of the first book. The title 7 of the Code of Civil Procedure prescribes the evidence rule which maches with chapter 3 title 2 of Korean Code of Civil Procedure. The first sub-title deals with documents, especially communication of the documents between parties and getting documents held by a third party, production of documents held by a party. The second sub-title prescribe preparatory inquiries. especially decisions on preparatory inquiries, personal appearance of the parties, statements of third parties, affidavits, investigation of witteness, preparatory inquiries implemented by an expert. The ordonance to deliver or to produce documents can be executed by astreinte, and the rules about affidavits of the third parties are concrete, and various method of preparatory inquiries implemented by an expert is prescribed in the Code of Civil Procedure.
