한국의 사내하도급 노동자들의 산업안전 현황 : 조선업을 중심으로

In-house subcontracting spreading from the manufacturing plant in Korea today is not only an economic trade relationship but also an employment relationship. In-house subcontract employment has a feature called "over-determined employment" to emerge in the process of subcontractors’ production activities by using the facilities and equipment of prime contractors within the same business. Therefore, both the prime contractors - the owner of the facility and equipment - and subcontractors who sign a contract of employment affect in-house subcontracted workers’ occupational safety and health(OSH). As a result, in-house subcontracted workers‘ OSH may be unclear responsibility. In this paper, based on a critical mind examines the realities and causes of spread of in-house subcontracted employment in the shipbuilding industry in which typically worked by many in-house subcontracted workers in Korea. And I stereotyped the occupational safety and health problems caused by the use of in-house subcontracted work. These problems are 1) in-house subcontracting structure itself has a negative influence on OSH of workers, 2) occupational accidents and diseases(OADs) Prevention aspects and 3) workers compensation aspects. In conclusion, it is necessary to develop social discussion about the joint responsibility of the both prime contractors and sub contractors in the problems of the OHS of in-house subcontract workers.
