초록
목민심서는 다산 정약용이 목민관인 지방 수령이 그 업무를 수행함에 있어 지켜야 할 사항들을 체계적으로 정리한 책이다. 이 책은 12편으로 이루어졌는데 그 중 제9편이 형전이고 그 중 제1조가 청송(聽訟)이다. 청송은 곧 소송 특히 민사소송을 의미한다. 다산은 청송의 근본은 성의(誠意)에 있다고 하였고 성의의 근본은 신독(愼獨)에 있다고 하였다. 그리고 이어서 다음과 같이 말하였다. “몸가짐을 규율하여, 훈계하고 가르치며 억울함을 풀어주면 또한 쟁송이 없어질 것이다. 청송을 물 흐르듯 거침없이 하는 것은 타고난 재능이 있어야 되는 것이니 이 방법은 위험하다. 청송은 반드시 하나하나 따져 해야 하니 이는 마음을 다하는 것으로 이 방법이 확실하다. 호소하고 싶은 백성으로 하여금 부모의 집에 드나들 듯이 하게 하여야 훌륭한 수령이라고 할 수 있다. 무릇 소송에 있어서 급하게 달려와 고하는 자가 있거든 그 말을 얼른 믿어서는 안 되고 늦추어 응하여 천천히 그 실상을 살필 것이다. 말 한마디를 가지고 옥송(獄訟)을 결단하여 정확하고 공정하게 판결하는 것은 천재(天才)만이 하는 것이니, 보통 사람이 흉내 낼 바는 아니다. 인륜(人倫)에 관한 소송은 천도(天道)에 관계되는 일이니 그 판단을 명확하게 하여야 한다. 친족 간의 소송에 있어 의(義)를 저버리고 재물만을 좆는 자는 마땅히 엄하게 다스려야 한다. 전답(田畓)에 관한 소송은 백성들의 재산에 관계된 것이므로 한결같이 공정하게 처리해야 백성들이 이에 승복할 것이다. 우마(牛馬)의 소송은 명성이 드러나는 곳으로, 선례들을 따르는 것이 좋다. 재물이나 비단에 관한 소송은 증거 문서가 없는 경우에도 그 실상과 허위를 자세히 살펴보면 사실이 드러나고 말 것이다. 마음을 비워 사물을 밝게 비추고 어진 마음이 하찮은 짐승에게까지 미치면 이채로운 소문이 퍼져 나가 아름다운 명성이 멀리 전해질 것이다.” 다산이 처한 사회적 경제적 상황이 현재의 그것과 다르고, 다산의 유학적 입장이나 철학을 그대로 수용하기는 어렵기 때문에 다산의 말씀을 그대로 따르는 것은 적절하지 못한 면이 있다. 그러나 재판관이 재판을 함에 있어서 지켜야 할 기본적인 원칙은 지금도 다르지 않다고 생각한다. 즉 끊임없는 수양과 절제를 통하여 자신의 인격을 높이고, 분쟁 관련자들이 그 분쟁을 해결할 수 있도록 법정의 문호를 개방하고, 당사자나 소송관계인을 인격적으로 대우하고 배려하며, 사건에 대한 철저하고 신중한 심리를 통하여 적정하고 공평한 결론을 도출해내고, 그럼으로써 같은 사건이 반복해서 일어나지 않도록 하는 것, 이것이 결국 재판관이 지향하여야 할 길인 것이다.
Abstract
Monkminsimseo(The Book on the Mind of Governing the People) is a book written by Dasan Jeong Yak-yong to systematically organize the key points for Mokmin-gwan, local leaders - governors - to abide by as they perform their tasks. The book is comprised of 12 units, among them the 9th unit is about the law book of Hyeongjeon (Justice) and Article 1 is a hearing. A hearing means a lawsuit - especially a civil suit. Dasan said the basis of a hearing is in sincerity and the basis of sincerity is in self contemplation. He also said “If you are prudent in your conduct, discipline yourself, lecture and teach people to solve their cases of injustice, disputes will also disappear. Performing a hearing flowingly without a hitch can only be done by those who have inborn talent, so this method is highly risky. A hearing have to weigh all the factors one by one and you have to perform the process with all your heart. A good leader should allow his people to come to him freely as if they visit their parents' home whenever they have something to plead. In cases of lawsuits, you shouldn't instantly believe what someone says when he or she comes on the hotfoot and you should figure out the truth slowly by taking your time to deal with it. Since making accurate and fair rulings just by listening to a word can be only done by geniuses, ordinary people cannot imitate making correct judgments to decide legal proceedings like them. Since lawsuits regarding morality are related to the way of Heaven, you have to make clear judgements. As for lawsuits between relatives, you ought to deliver a strict reprimand for those who turn away righteousness and only pursue wealth. Lawsuits regarding farmlands are related to our people's property, so they should always be handled fairly to make people accept the results. Since lawsuits on horses and cows show your reputation, you should generally follow the precedents. Regarding lawsuits on wealth or silk, the truth will be revealed by sorting through true and false facts even when there is no evidential documents. If you empty your mind to lighten up the world and deliver your benevolentness even to lowly animals, beneficial comments about you will spread out and your beautiful reputation will be widely known.” It is difficult to accept Dasan's Confucian stance and philosophy as they are and it seems somewhat inappropriate to completely follow what he said since his social and economical situations are different from today. However, the basic principles for judges to observe when holding trials are not different even today. In other words, judges should seek ways to improve their personality through fairly, open doors of the courts for those who are in dispute with someone to solve their conflicts, treat and consider plaintiffs and those who involved in litigations humanely, and draw appropriate and fair conclusions through thorough and careful hearings about cases to prevent the same cases to occur repeatedly.
