부동산경매의 최저매가가격제도에 관한 고찰

부동산경매에서 최저매각가격이란 당해 사건의 매각기일에서 당해 부동산을 그 가격보다 저가로 매각할 수 없고, 그 가격 이상으로 매각함을 요하는 가격으로 법원이 정한 기준가격이다. 그러나 최저매가가격제도는 그 긍정적 기능에도 불구하고 부동산경매의 신속성제고라는 관점에서는 문제가 있다. 본고에서는 최저매각제도와 외국의 관련 제도를 고찰하고, 최저매각가격제도의 문제점과 그 개선방안을 검토하였다. 첫 매각기일에서의 매각율을 높이기 위해서는 일본에서 채택한 매각기준가격제도의 도입을 검토할 필요가 있다. 매각기준가격제도의 도입에 대해 기준가격을 정하는데 대한 법원의 재량과 남을 가망이 없을 경우 경매 취소 사례의 증가 등 을 이유로 이 제도의 도입에는 문제가 있다고 지적하며 반대하는 것은 타당하지 않다고 생각한다. 매각기준가격제도는 최저매각가격제도의 기본적인 틀을 유지하면서 최저매각가격제도의 문제점도 어느 정도 해결할 수 있고, 첫 매각기일의 매각율을 분명히 높이는 효과가 나타날 것이다. 따라서 필자는 기준매각가격제도에로의 변경을 제안하였다.
Abstract
A court shall have an appraiser appraise immovables, and determine the minimum sale price by taking account of such appraised price. The minimum sale price in real estate auction means the immovables can not sell in date of sale at a lower cost than the market price, the sale price should required standard price set by the court at that price or higher. However, the minimum sale price system has problem in terms of speed and the increase in the real estate auction in spite of its positive functions. The paper examines the minimum sale system and related foreign institutions, and reviews the problems and the improvement of the minimum sale price system. In order to increase the sales rate in the first sale date, it is necessary to examine the introduction of standard sales price system adopted by Japanese Civil Execution Act. I do not think it is reasonable opinion to oppose the introduction of standard sales price system, this system will increase the revocation of auction due to no surplus and the court has discretion to be exercised in determining the minimum sale price. The standard sales price can not solve the problem to some extent the minimum sale price system while maintaining the basic framework of minimum sale price system. Therefore, I suggested to change to the standard sales price system.
