지방자치강화를 위한 자치경찰제의 확대에 관한 공법적 검토

근대의 산업사회는 국가의 총체적인 역량을 모두 중앙에 집중하여 정부 주도로 경제성장을 이룩하였다. 우리나라 역시 정부가 중심이 되어 모든 권한과 역량을 집중하는 시스템을 통해 경제개발을 이끌었으며, 오늘날과 같은 성장을 달성하였다. 그러나, 경제가 일정한 괘도에 다다른 오늘에 있어서는 과거와 같은 정부주도의 시스템을 가지고는 더 이상의 성장을 담보할 수 없게 되었다. 세계적인 흐름도 분권화, 다핵화로 가고 있고, 사회 각 영역이나 각 지역의 자율성을 인정하고 각자의 처지에서 최고의 역량을 발휘한다면 결국 국가 전체의 경쟁력도 제고된다는 것이다. 이처럼 지방분권은 자기 지역의 일을 자신이 처리하게 함으로써 민주주의의 실현에도 기여할 뿐만 아니라 오늘날 경제성장의 관점에서도 더 이상 선택이 아닌 필수적인 요소가 되어 가고 있다. 우리나라도 지방자치를 확대해 나가고 있는데, 지방자치의 중요한 제도중 하나인 자치경찰제의 확대에 있어서는 구체적이고 전면적인 시행이 미루어져 오고 있다. 선진외국사례를 검토한 결과, 현 단계에서 우리가 취할 수 있는 최선의 자치경찰제 도입모형은, 시․도 단위 광역자치경찰제와 국가경찰의 조정통제 기능을 효과적으로 결합시키는 것이어야 하며, 국가경찰과 지방자치경찰 모두 대표성을 갖춘 민간인으로 구성된 경찰위원회의 관리 하에 두되 구체적 법집행과 경찰업무 수행에 대한 시도단위 경찰지휘자의 독자적 지휘권을 확보해 줌으로써 공정하고 효율적이며 지역실정에 맞고 주민의 요구에 부응하는 치안서비스를 제공할 수 있도록 하여야 할 것이다. 또한, 현행 제주자치경찰제는 제주자치경찰단의 사무에서 극히 제한적 권한만 부여되어 현장업무수행이 곤란하다는 문제점이 지적되고 있기 때문에, 자치경찰의 사무와 부합하는 수사권과 권한이 주어짐으로써 직무수행을 함에 있어 당하는 어려움을 최소화시킬 필요가 있다. 이처럼 정치적 중립성을 확보하기 위한 위원회중심의 광역단위로 하여 수사 및 정보업무를 자치경찰에 부여하는 것을 골자로 하는 자치경찰법안을 마련하게 되면, 사무이관에 따라 자치경찰제의 확대를 위한 재원의 문제도 국가경찰의 사무가 대폭 줄었기 때문에 국가경찰의 재원을 재분배하고, 과태료나 범칙금 등을 자치경찰로 이관하는 형태로 원칙을 가져간다면, 국가나 지방자치단체에 큰 부담은 없으리라 판단된다. 그밖에 ‘자치경찰제’를 전국적으로 확대하면서 정비되어야 하는 법률에는 경찰법․경찰공무원법․정부조직법․지방자치법․지방재정법․지방공무원법이 있고, 위의 6개 법률은 별도의 개정절차로 개정되어야 할 것이고, ‘시․도 경찰재정교부금법’은 새로 제정해야 할 법률이다. 그밖에 도로교통법․행정심판법 등 20여개의 법률은 경찰법의 부칙으로 일괄 개정하여야 할 것으로 보인다.
