한국 지방의회 입법권의 분석을 통한 중국 지방입법권의 개선방안

From the view of South Korean legislative system, there are clarity and rationality in the latitudinal way and practicability and suitability in the longitudinal way. On the whole, the central legislative authority is divided into three parts, which is belonged to Congress, President and Administration. The local legislative authority is also divided into three parts, which is belonged to local parliament, local self-governing body and superintendent of education. In order to reduce the possibility of conflict legislation, repeated legislation, legislation beyond one's power, and even the blank of legislation, when they give power, the same time, they draw the boundaries of transaction and time. The main reason is that the clarity of the division of legislative authority, detailed legislation, rational object of legislative authority and a series of principles are applied on the transfer of legislative authority. It is obvious that the legislative system of China is totally different from the Korea. Because of the lack in the clarity of legislative competence, careless legislative and lack of the regulation of goal and principles on transfer of legislative authority, legislation disorder, the legislation of tort in the practice of legislation. Base on South Korean legislative system, especially the local council legislative power, it would provide experiences and insights for the legislative system of China.
