고위경영자의 횡령·배임죄 양형현황 및 개선방안
An Empirical Study on Sentencing ofSenior Manager in Embezzlement/Breach of Trust Crime

2011년부터 2013년 선고된 횡령·배임범죄 1심 판결문에 대한 양형기준 준수현황을 살펴본 결과, 단독재판부 사건보다 합의부 사건에서 선고형의 권고형량 부합율이 떨어진다거나, 제1유형의 부합율은 높은 것에 반해 제4유형, 제5유형과 같이 중한 유형에서 부합율이 낮아지는 것이 발견되었다. 이러한 결과는 고위경영자들의 횡령·배임 행위에 대하여 엄벌을 요구하는 일반국민들의 법감정과 부합하지 않는 면을 보여준다. 이에 본 연구에서는 횡령·배임범죄 중 고위경영자에 대한 양형기준현황을 중심으로 양형기준제도의 시행결과를 살펴보았다. 본 연구에서 분석된 자료는 횡령·배임죄의 1심 판결문 중 대검찰청 ‘검찰사건처리정보시스템(Prosecutorial Guideline System: PGS)’에 보관되어 있는 판결문으로 판결일자를 기준으로 2009년 1월 1일부터 2013년 12월 31일에 선고된 6,914건을 분석대상으로 삼았다. 고위경영자에 대한 횡령·배임범죄의 양형현황을 분석한 결과, 양형기준제도를 적용한 사건 중에서 최고고위직의 유형등급은 다른 직위에 비하여 상대적으로 높지만 감경영역의 비율이 높은 편이고, 선고형량에 대한 부합양상의 경우, 고위직 및 최고고위직의 경우에 하한 이탈이 상대적으로 높은 편으로 나타났다. 또 양형의 경우에 고위직 및 최고고위직의 선고형량은 높은 편이지만, 최고고위직의 경우에 다른 직위에 비하여 집행유예의 비율이 현저하게 높은 것으로 나타났다. 그리고 실형량의 경우, 최고고위직은 높은 집행유예로 인하여 실형량이 낮은 것으로 분석되었다. 특히 횡령·배임의 이득액을 반영하는 유형등급을 통제한 상황에서도 최고고위직의 실형량은 제5유형을 제외하고는 다른 직위에 비하여 낮은 것으로 분석되었다. 물론 이러한 분석결과는 횡령·배임범죄 1심 판결 전체에 대한 분석이 아니라 ‘검찰사건처리정보시스템’상의 판결문을 통하여 살펴보았다는 점에서 일정부분 한계를 갖고 있다. 그러나 실증적 연구를 통해 국민적 관심이 높은 고위경영자의 횡령·배임범죄에 대한 양형기준제도의 운영현황과 그 처벌정도를 이해하고 그 개선방안을 모색하는데 도움이 될 것으로 생각된다.
Abstract
The purpose of this study is to investigate on judges’ practices of sentencing of senior manager on Embezzlement/Breach of Trust Crime. We try to examine the effects of occupational position variable on sentencing overcomes. The data analysed in this study were obtained from sentencing in court of first instance in Korea, kept files in Prosecutorial Guideline System(PGS) of the Supreme Prosecutor’s Office. The data consists of a total of 6,914 of sentencing of Embezzlement/Breach of Trust Crime sentenced between January 1, 2001 and December 31, 2013. We used cross-tabulation tables and ANOVA. The results indicate that the judicial decision to sentence such as prison/probation and length of the sentence imposed on Embezzlement/Breach of Trust Crime are affected by offence severity(crime severity level) and occupational position of offender. When crime severity level is controlled, the occupational position of offender is negatively related to the sentence length. On the sentencing of the Embezzlement/Breach of Trust Crime, length of the sentence of senior manager is lower than other occupational position. And we wish this study to contribute to the understand and explanation of sentencing of senior manager on Embezzlement/Breach of Trust Crime in our society. From our study, it is implied that future research should attempt to develop a more considerable empirical study.
