공간정보 법제의 문제점과 개선방안 -공간정보의 구축 및 관리 등에 관한 법률을 중심으로-

박근혜 정부는 2014년 6월, 공간정보산업을 창조경제의 핵심산업으로 육성하기 위해 국가공간정보기본법, 공간정보산업진흥법, 공간정보의 구축 및 관리 등에 관한 법률을 개정·공포하였다. 이들 공간정보 3법은 국가공간정보기본법을 중심으로 공간정보의 구축 및 관리 등에 관한 법률과 공간정보산업진흥법이 서로 연계하여 공간정보관련 산업의 시너지효과를 창출하고자 하는데 목적이 있었으나 이들 3법의 규정내용은 그 입법목적과 달리 연계성을 찾아보기 어렵다. 특히 공간정보의 구축 및 관리 등에 관한 법률은 2차원 지적 정보만을 등록·공시하도록 규율함으로써 토지에 관한 3차원의 공간정보개념을 포함하고 있지 않다. 이것은 실제의 토지이용현황이 이미 지표·공중·지하의 3차원의 입체적 활용이 이루어지고 있음에도 불구하고 2차원 지적만을 등록·공시한다는 점에서 동법률은 부동산공시법규로서 그 기능을다하지 못하고 있을 뿐만 아니라 공간정보3법 중의 하나로서 3차원의 공간정보를 등록·관리하여야 함에도 불구하고2차원 지적만을 등록·관리하도록 함으로써 다른 공간정보법률과의 연계성을 가지지 못한다는 문제점을 발생시킨다. 본 연구에서는 이러한 문제점을 개선하기 위한 방안으로서 2차원 지적만을 등록·공시하도록 규율한 공간정보의 구축및 관리 등에 관한 법률 제64조 내지 제68조의 규정내용을 3차원의 공간정보개념을 등록·공시할 수 있도록 개정할 것과 입체적 지적공부를 도입할 것을 제안하였다
Abstract
Park Geun-hye Government revised and proclaimed the National spatial data infrastructure act, the Spatial data industry promotion act, and the Act on the establishment, management etc. of spatial data to promote spatial information industry as a key industry of creative economy in June 2014. The purpose of the above three Acts related on the spatial information is to maximize the synergy effect of spatial information industry by relating the Act on the establishment, management etc. of spatial data and the Spatial data industry promotion act to the National spatial data infrastructure act. However, it is difficult to find the systematic connectivity among the provisions of the three Acts. Especially the Act on the establishment, management etc. of spatial data treats two-dimensional cadastral information and does not involve three-dimensional cadastral information, and thus does not function as an act associated with real estate public announcement. This paper proposes that the provisions of the Act should be revised to include the registration and public announcement of three-dimensional cadastral information and the introduction three-dimensional cadastral record
