학교보건법상의 금지시설인 호텔에 대한 법리적 검토 - 관광진흥법상의 예외규정과의 비교를 중심으로 -
A Study on ‘hotel’ as Prohibited Facility under School Health Act - Focusing on comparative study of exceptional clause in Tourism Promotion Act

학교보건법 제6조 제1항에서는 학교환경위생정화구역 내에서 원칙적으로 금지되는 시설과 행위에 대하여 규정하면서 예외적으로 상대정화구역의 경우 학교환경정화위원회의 심의를 거쳐 학습 및 학교보건위생에 나쁜 영향을 주지 아니한다고 인정을 받으면 일정한 행위 및 시설이 허용될 수 있도록 하고 있다. 문제는 학교보건법 제6조 제1항 각호상의 금지되는 행위 및 시설들을 살펴보면, 대부분은 금지 행위 및 시설의 명칭만을 보아도 구체적인 시설의 특징, 운영의 행태 등을 파악할 수 있지만, 학교보건법 제6조 제1항 제13호에서 금지되고 있는 “호텔”의 경우는 여러 법에서 종류를 세분화하여 나누고 있음에도 불구하고 학교보건법에서는 호텔 전체를 금지하고 있다는 것이다. 학교보건법 제6조 제1항 제13호 중 호텔 부분의 위헌성을 주장하며 제기된 위헌법률심판제청신청에서 대법원은 위 조항이 과잉금지원칙에 반하여 과도하게 직업수행의 자유나 재산권을 제한한다거나, 명확성 원칙에 반하지 않는다고 판단한 바 있다(대법원 2012. 6. 28.자 2012아35 결정). 위와 같은 대법원 결정에도 불구하고 과연 상대정화구역 내 호텔 전부를 원칙적으로 금지시킬 필요성이 있는 것인지, 예외규정을 마련할 필요가 없는지에 대하여는 정부기관 내에서도 입장차이가 있어왔는데, 2015. 12. 22. 관광진흥법 제16조 제7항 및 동법 시행령 제14조의 2가 신설되어 일정한 요건을 모두 충족한 관광숙박시설에 대하여는 학교보건법 제6조 제1항 제13호를 적용하지 아니하는 예외규정이 마련되었다. 즉, 학교보건법 제6조 제1항 제13호를 수정하는 것이 아니라 별도의 법에서 학교보건법 해당 조항의 예외를 마련하는 형식을 취한 것이다. 분명히 호텔은 다른 종류의 금지시설과 달리 여러 법에서 다양한 종류로 존재하며, 실제 운영 형태나 등급의 차이도 천편일률적이지 않기 때문에 획일적 취급이 바람직하지 않은 것은 사실이고, 기존 영화관 사례에서 알 수 있듯이 호텔 역시 일정하고 엄밀한 분류를 통해 예외를 유형화를 하는 것이 불가능한 것도 아니다. 따라서 이러한 관광진흥법상의 예외규정은 긍정적인 부분이 있다고 판단된다. 다만, 현재의 관광진흥법상의 예외규정은 시설의 외적인 측면만을 중요하게 고려하고 있다. 그러나 그동안 호텔 등과 같은 숙박시설과 관련하여서 문제되었던 것은 시설의 “외적 측면”보다는 이른바 러브호텔로의 운영 등 “운영 행태”가 더 문제되었다는 점이 결코 간과되어서는 아니 될 것이다. 그런데 이러한 운영 행태는 시설의 외적 측면에서 미루어 짐작을 할 수는 있지만, 반드시 외적 측면과 동일하게 판단할 수 있는 것은 아니므로, 운영 행태가 조금이라도 교육적 효과에 반할 수 있다면 건축 전 이를 억제할 수 있는 보완조치가 굉장히 중요하다고 판단되고, 추후 관광진흥법상의 예외 규정이 적용된 관광호텔 사례들을 보며 이러한 보완조치에 대한 연구가 계속 지속될 수 있도록 하여야 할 것이다. 나아가 관광진흥법상의 예외규정이 적용되지 않아 원칙적으로 학교보건법 제6조 제1항 단서에 따른 학교환경위생정화위원회의 심의를 받게 되는 호텔들에 대하여는, 호텔의 다양성, 시설의 특수성 등을 고려하여 학교환경위생정화위원회의 심도 있는 심의가 필요하며, 이를 위해 각 시설 분야 전문가가 위원 중에 포섭될 수 있도록 풀을 넓힐 필요가 있고, 교육부 훈령인 관광호텔업에 관한 학교환경위생정화위원회 심의규정을 적극 참조할 필요가 있다고 사료된다. 이러한 심도 있는 심의과정을 거쳐야만 자라나는 학생들에 대한 보호를 목적으로 하는 학교보건법의 입법취지를 최대한 살리면서 학교보건법상의 금지로 인하여 제한되는 국민의 재산권이나 직업수행의 자유 역시 최대한 보장하는 조화로운 결정이 될 수 있을 것이다.
Abstract
Clause 6 (1) of School Health Act stipulated prohibited acts and facilities in school environmental sanitation and cleanup zone as a general rule and allowed acts and facilities exceptionally in case where the school environmental sanitation and cleanup committee ratifies such acts and facilities do not have adverse influence on learning, school health and sanitation in the cleanup zone. It is understandable why those acts and facilities are prohibited in Clause 6 (1) of School Health Act by its self-explanatory names listed therein. However, ‘hotel’ as one of prohibited facilities in Clause 6 (1) of School Health Act is considered as one and prohibited as a whole even if ‘hotel’ is viewed as various types, meanings and categories in other laws. In an adjudication case on constitutionality of statute regarding unconstitutionality of adding ‘hotel’ to item 13 of Clause 6 (1) of School Health Act, the Supreme Court held that such Clause does not excessively infringe freedom to conduct business or property rights and not against principle of excess prohibition, and further does not infringe principle of clarity (the Supreme Court 2012. 6. 28. 2012ah35 kyul-jung). Notwithstanding the foregoing adjudication by the Supreme Court, debatable opinions have been raised in the government whether it is necessary to prohibit all hotels from constructing in cleanup zone as a rule or it is necessary to have exceptional clause, and eventually Tourism Promotion Act and Enforcement Decree of the Tourism Promotion Act were amended on December 22, 2015 wherein Clause 6 (1)(13) of School Health Act does not apply to certain tourism-accommodation facilities satisfying all conditions required in newly added Clause 16 (7) of Tourism Promotion Act and Clause 14-2 of Enforcement Decree of the Tourism Promotion Act, which provides exception in Clause 6 (1)(13) of School Health Act by amending other law (i.e., Tourism Promotion Act) not by amending School Health Act. Hotels exist in various types, meanings and categories in other laws as opposed to other prohibited facilities listed in School Health Act, and the form of its management and operation and grades are not the same. Therefore, treating all hotels as the same as a whole is not appropriate. As we have experienced in movie theater case, it is not impracticable to standardize exceptions in hotel by applying consistent and firm classification. For that reason, exceptional clause in Tourism Promotion Act has positive aspect. One thing however to point out is that exceptional clause in Tourism Promotion Act weighs too much on external elements of the facility, such as number of rooms, location and distance to school, etc. It is important to note that the form of operation, such as love hotel, etc. has been an issue more than external elements of the hotel. Even if we can predict how the form of operation will be by looking at external elements of the hotel, but that does not mean external elements dictate form of operation. If there is probability of certain form of operation in hotel to adversely influence on learning, school health and sanitation, complementary measures to restrain adverse influence prior to construction of hotel is important. Therefore, it is required to continue studying on complementary measures by reviewing the hotel cases reflecting exceptional clause of Tourism Promotion Act. Further, for the hotels, not applicable to exceptional clause of Tourism Promotion Act, and subject to deliberation by the school environmental sanitation and cleanup committee pursuant to Clause 6 (1) of School Health Act, it is critical to a) have in-depth deliberation by the school environmental sanitation and cleanup committee by acknowledging variety of hotel and uniqueness of its facility as such; b) expand the pool of experts to include experts in various fields of facilities to the committee; and c) actively make reference to deliberation rules and regulations (i.e., Order of the Ministry of Education) in deliberation by the school environmental sanitation and cleanup committee. Such in-depth deliberation by the school environmental sanitation and cleanup committee gives rise to satisfying legitimacy of School Health Act pursuing protection of school students as well as balancing by assuring property rights and freedom to conduct business limiting by School Health Act.
