한국 유아교육기관 관련 판례 분석
An Analysis on Legal Cases Involving Early Childhood Education and Care Institutes in Korea

초록
본 연구는 시대적 변화에 따른 유아교육 관련 법률의 변화와 사회적 양상을 다각도로 살펴보고자 1949년부터 2014년까지의 대법원 판례와 헌법재판소 결정례를 분석하였다. 그 결과, 첫째, 유아교육기관 관련 판례의 현황(기수별, 기관 유형별, 재판 유형, 소송 주체, 소송 내용 유형)에서 기수별 현황은 1기 7건, 2기 24건, 3기 46건, 4기 93건으로 나타났다. 기관 유형별 현황은 총 170건의 사례 중 유치원 93건, 어린이집 77건으로 나타났다. 재판 유형 현황은 행정재판사건 66건, 민사재판사건 64건, 형사재판사건 25건, 헌법재판사건 15건이 나타났다. 소송 주체 현황은 기타(검사, 기관 매도관련자 등) 69건, 원장(유치원경영자 포함) 51건, 영유아(부모) 21건, 기관(법인) 17건, 교사 12건으로 나타났다. 둘째, 유아교육기관 관련 법적 분쟁의 양상(설립․인가․폐쇄․허가, 부동산 및 세금, 건강․영양․안전, 학대, 인사, 교육환경, 기타)에서 부동산 및 세금 56건, 설립․인가․폐쇄․허가 31건, 건강․영양․안전 26건, 인사 21건, 교육환경 13건, 학대 10건, 기타 13건순으로 나타났다. 결론적으로 시대가 변화함에 따라 유아교육기관을 둘러싸고 있는 분쟁이 점점 더 심화되고 있으며 복잡화․다양화되고 있음을 확인할 수 있었다. 이러한 연구결과는 유아교육현장에서의 다양한 법적 분쟁을 인식함으로써 관련 분쟁의 재발 방지와 예방 및 교육을 위한 기초 자료를 제공할 것으로 생각된다.
Abstract
The purpose of this study was to provide basic data for prevention and education of disputes relating to early childhood education and care institutes. To this end, we examined the changes in early childhood education-related laws and social aspects along with the changing times from various angles, and analyzing and understanding various legal disputes occurred in the field of early childhood education. The research questions were as follows: What is the current status (depending on the year of establishment, the institution type, the type of lawsuit, the party in lawsuit, and the contents type of lawsuit) of the legal cases involving early childhood education and care institute? and What are the aspects (establishment/authorization/closure/permission, real estates and tax, health/nutrition/safety, abuse, personnel affairs, educational environment, and others) of the legal disputes involving early childhood education and care institutes? In conclusion, the present study may help prevent disputes by letting early childhood education-related persons examine the social aspects related to early childhood education along with the changing times from multiple angles, and indirectly experience the various disputes that may arise in the early childhood education field.
