디엔에이신원확인정보의 형사상 활용에 따른 법률적 문제점과 개선방안 - 미국의 CODIS 등 외국의 활용현황에 대한 고려를 기반으로 -

갈수록 흉포화되어 가고 있는 현대의 범죄현상들에 적절하게 대응하기 위해서는 디엔에이정보 등을 활용하는 과학수사(Forensic Science)가 필요하다는 점에는 이론이 없을 것이다. 2010. 1. 25. 법률 제9944호로 제정되어 2010.7.26. 시행된 「디엔에이신원확인정보의 이용 및 보호에 관한 법률(이하: ‘디엔에이법’)」은 이러한 필요에 치우친 나머지 인권침해의 가능성을 비롯한 다양한 문제점에 대한 보호장치를 마련함에 소홀했다고 할 수 있다. 게다가 동법이 제정된 이후 개인정보의 보호에 대한 일반법인 (통합)개인정보보호법이 제정되었고, 디엔에이신원확인정보도 개인정보이므로 양법률 사이의 관계를 전제로 일반법인 개인정보보호법의 가치체계 속에서 디엔에이법의 문제점을 검토해야 하는 상황에 이르렀다. 여기에서 디엔에이법이 시행된 이후 상당한 시간이 흘렀음에도 다시금 동법을 검토해야 할 필요성을 찾을 수 있으며, 이러한 문제의식에서 형사상 디엔에이신원확인정보의 활용과 관련한 법률적 문제점과 그 개선방안을 살펴보고자 하였다. 이를 위하여 먼저, 디엔에이 신원확인정보의 활용가능성과 미국을 중심으로 하는 제외국의 활용현황(Ⅱ)을 살펴보았으며, 현행 디엔에이신원확인정보의 이용 및 보호에 관한 법률의 문제점(Ⅲ)을 검토하였다. 특히 인간의 존엄성, 정보자기결정권 그리고 무죄추정의 원칙 등과의 관계에서 디엔에이정보를 활용하는 것이 타당한지에 대한 법률이론적 논의가 이루어지고 있어서 이에 대한 기존의 논의를 정리하고 이를 검토하였다. 그리고 이를 기반으로 현행 법률의 체계적 정비방안과 제도의 개선방안(Ⅳ)을 모색하고자 하였다. 이러한 검토의 결과 ① 법률목적의 명확화, ② 디엔에이정보 수집대상의 합리적 축소, ③ 통합개인정보보호법과의 관계에서의 체계정합적 정비라는 세 가지가 가장 시급한 과제에 속한다는 점을 지적할 수 있었다. 이 중에서 개인정보보호법과의 관계에서 체계적 정합성을 확보하는 문제는 개인정보보호법이 등장한 이후 다양한 분야에서 문제되고 있는 단골소재들 중 하나로서 디엔에이법만의 문제는 아니지만, 그럼에도 불구하고 디엔에이법은 개인정보 중에서도 민감정보로 취급되어야할 내밀한 정보를 그 대상으로 하고 있기 때문에 특히 섬세한 검토가 필요한 분야라는 점을 강조하였다.
Abstract
Forensic science that makes use of DNA information is needed to take proper actions against modern crime phenomenon that has become ferocious. Act on Use and Act on Use and Protection of DNA Identification Information (hereinafter called DNA law) that was enacted by law No. 9944 on January 25, 2010 to be effective from July 26, 2010 considered such a need too much to neglect protective devices against infringement upon human rights. Since enactment of the law, act on (integrated) personal information of common corporation to protect personal information. DNA identification information, personal information, is subject to relations of both laws to have values of personal information protection law of common corporation and to investigate problems of DNA law. At time elapse after enactment, DNA law is needed to review. The study investigated legal problems and reformation of use of criminal identification information. The study investigated possibility of the use of DNA identification information and use of the information in USA and other countries(Ⅱ) and legal problems(Ⅲ) on the use and protection of DNA identification information. The study investigated systematic maintenance and reformation of the law(Ⅳ). At discussion, three problems should be urgently solved: ① Clarification of legal purposes, ② reasonable lessening of DNA information collection, ③ systematic consistency at relation with personal information protection law. Systematic consistency at relation with personal information protection law was thought to be important, and DNA law had sensitive information of personal information to require careful investigation. Technical development could give benefit when laws were reformed at rapid changes of scientific technology: If not, negative effect could be made to create surveillance society.
