보통 한 국가는 국내무대뿐만 아니라 국제무대에서도 국가 자격으로 많은 활동을 하고, 그 국가의 헌법에서는 그러한 활동의 근거가 되는 권한들의 행사 요건, 방법, 범위 등에 대해 근거규정들을 두고 있다. 특히 미국과 같은 연방국가에서는 연방 행정부를 이끄는 대통령, 연방의회, 연방 대법원이 이러한 국제관계의 권한들에 대해 여러 권한들을 나누어 가진다. 본 연구는 미국 연방헌법상 국제관계의 권한 중 조약의 체결 및 비준 동의권과 전쟁에 관한 권한의 배분에 대해 연방헌법상의 관련 조항들과 미국 연방대법원의 주요판결들 및 이를 통해 귀납된 법리들을 중심으로 자세히 분석해보는 것을 연구의 목적으로 삼는다. 이를 위해 우선 미국 연방헌법상의 조약 체결과 비준 동의 및 전쟁에 관한 권한 규정들을 살펴보고, 이러한 국제관계의 권한 행사와 관련된 여섯 개의 미국 연방대법원 주요 판결들을 시기 순으로 자세히 분석해본다. 1920년의 Missouri v. Holland 판결, 1936년의 United States v. Curtiss-Wright Export Corp.판결, 1948년의 Woods v. Cloyd W. Miller Co. 판결, 1952년의 Youngstown Sheet & Tube Co. v. Sawyer 판결, 1979년의 Goldwater v. Carter 판결, 2004년의 Hamdi v. Rumsfeld 판결이 그 여섯 개의 판결들이다. 그 후에 조약의 체결 및 비준 동의권과 전쟁에 관한 권한의 배분에 대해 미국 연방대법원의 주요판결들의 분석을 통해 귀납된 법리들을 국제관계에서의 권한들, 조약과 행정협정, 전쟁에 관한 권한들을 중심으로 자세히 규명해본다.
Abstract
A nation plays an active part in international arena in a national capacity as well as in domestic areas. The Constitution of the nation has some provisions on the scope and the requirements of the international powers as constitutional grounds. Especially, the constitutional powers in the international areas are divided among the President, the Congress and the Supreme Court based on the Separation of Powers doctrine. This paper aims at exploring the principles of law on the international powers such as Treaty-Making Power, Treaty-Consenting Power and War Powers in the United States by analyzing the concerned major decisions by the U.S. Supreme Court as well as the concerned provisions in the U.S. Constitution. To achieve the aim, this paper will overview the provisions on the Treaty-Making Power, Treaty-Consenting Power and War Powers in the U.S. Constitution at first. Then, it will analyze in details the six major decisions by the U.S. Supreme Court on the issue including Missouri v. Holland in 1920, United States v. Curtiss-Wright Export Corp. in 1936, Woods v. Cloyd W. Miller Co. in 1948, Youngstown Sheet & Tube Co. v. Sawyer in 1952, Goldwater v. Carter in 1979, and Hamdi v. Rumsfeld in 2004. Based on the analyses above, this paper will inductively explore the legal principles on the constitutional power divisions in the international areas focusing on the issues of treaty, executive agreements and the war powers.
