사이버공간에서 온라인암표매매 관리ㆍ감독의 헌법적 의미와 입법방안에 관한 연구

초록
최근 오프라인상에서의 암표매매뿐만 아니라 온라인상에서도 암표매매가 급증하고 있다. 이러한 인터넷암표매매는 공식적인 판매처가 아니라 다수의 표를 확보해 시세보다 높은 가격으로 판매하는 암표상들에 의해서 발생하는 것으로 인터넷전자거래가 확대되는 상황에서 최근 암표매매의 행태가 과거의 오프라인암표매매에서 점차 사이버공간상에서 온라인암표매매로 변화하고 있다. 그러나 현재 암표매매관리ㆍ감독에 관해 규정하고 있는 「경범죄처벌법」은 “흥행장ㆍ경기장ㆍ역ㆍ나루터ㆍ정류장 등 요금을 받고 입장ㆍ승차ㆍ승선시키는 곳에서 웃돈을 받고 표를 다른 사람에게 되판 사람에겐 20만 원 이하의 벌금 등을 물릴 수 있다”라고 규정하면서 오프라인암표매매만을 명시할 뿐 온라인암표매매관련규정이 없어 현행법상 온라인암표매매행위에 대한 실효적 통제가 용이하지 않다. 더욱이 최근에 발생하는 암표매매는 오프라인보다 주로 사이버공간상에서 인터넷을 이용하여 발생하는 온라인암표매매의 경우가 대부분이기 때문에 암표매매행위는 사실상 단속 등의 적절한 관리ㆍ감독을 받지 않는 법의 사각지대에 놓여 있는 것이 현재의 상황이다. 따라서 본 연구를 통하여 최근 급격하게 증하고 있는 온라인암표매매 관리ㆍ감독의 헌법적인 의미와 함께 통제해야할 필요성이 적지 않은 온라인암표매매행위에 대한 적절한 관리ㆍ감독을 위한 실효성 있는 입법방안에 대해서 살펴보고자 한다.
Abstract
According to the recent report, online trade of ticket scalping is rising sharply in cyberspace. In the information age, economic order cannot be sustained without management of online ticket scalping. One of the reason that scalped ticket should be restricted is ticket scalpers charge an exorbitant amount of money by selling online ticket scaling such as concert tickets, train tickets, opera tickets, campus festival tickets and so on. Current law, 「The Minor Offenses Act」 does not prescribe for online ticket scalping. In this situation,「Revision of The Minor Offenses Act」 including the contents of online ticket scalping could not pass the committee in 2013. Despite the management and supervision of online ticket scalping, bills were not ratified until now. Above all, law regarding online ticket scalping should be established as soon as possible for the protection of consumer’s rights, property rights, maintenance of order etc which is protected in 「the Constitution of the Republic of Korean」. Therefore this study is going to present constitutional mining and plans for legislation of management of online ticket scalping should be managed and prohibited.
