이주근로자 사업장에서의 다문화인권교육

이 연구는 이주근로자의 인권을 증진하기 위해 다문화인권교육의 제도 개선 방안을 모색하는 것을 목적으로 하였다. 이를 위해 본 연구에서는 먼저 이주근로자 관련 다문화교육 또는 인권교육 현황을 살펴보았다. 이를 통해 현행 이주근로자 관련 다문화교육이 여전히 다문화이해교육에 머물러 있다는 점, 이주근로자와 함께 일하는 한국인 동료나 사업주의 인권의식 함양을 위한 교육 내용이 없다는 점 등의 한계점을 발견하였다. 또한 이주근로자의 인권을 증진하기 위해서는 처벌 규정이 없는 선언적 차별 금지 규정만으로는 현실적인 한계를 극복하기 어렵다고 보았고, 사회적 소수자의 인권을 증진하기 위한 인권교육 관련 입법례에서 인권에 취약한 영역에서 사업주 등에게 인권교육을 의무로 부과하는 규정들을 살펴봄으로써 다문화인권교육이 개선되어야 한다는 시사점을 도출하였다. 이에 따라 다문화인권교육 개선 방안으로 이주근로자 입국 단계에 따라 제도를 개선해야 할 사항들을 제시하였다. 아울러 이주근로자가 종사하는 사업장에서 고용사업주에 대한 교육의 의무화, 내국인과 외국인근로자의 통합교육이 필요하다는 점을 강조하였다.
Abstract
This study aims to explore strategies for improving human right and multicultural education for immigrant workers in Korea. In this study, we examined current situation of human rights education for immigrant worker and the result implied that current human right education remained as the understanding multicultural society and there is no education program to improve consciousness of human right for both employers and Korean workers. In addition, according to the rule concerning the application of the related law, employers who hire immigrant employees should be imposed duty to be provided the human right and multicultural education. As a result, human right and multicultural education has to be developed as follow: first, the human right and multicultural education for employers should be made as compulsory. Second, this education should be compelled by law. Third, systemic educational program for human right and multicultural education should be researched and provided. Fourth, cultural activities involved both immigrant worker and Korean worker can be used as a way of education. Lastly, integrated education engaged employer and immigrant workers together should be considered for enhancing safety and communication in the workplace.
